CC Resolution 10008 RESOLUTION NO.---.l0008 RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE MEMORANDUM OF UNDERSTANDING REGARDING THE OPERATION OF THE AUTOMATED FINGERPRINT IDENTIFICATION SYSTEM AND TO PROVIDE LOCAL LAW ENFORCEMENT AGENCIES ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM AND AUTHORIZE THE CITY MANAGER TO EXECUTE FUTURE AMENDMENTS AND/OR AGREEMENTS, AND TO AUTHORIZE STAFF TO INCORPORATE THE PROGRAM'S ANNUAL RENEWAL EXPENSES INTO THE .APPROPRIATE FISCAL YEAR'S BUDGET. WHEREAS, on April 26, 1988, the County of Santa Clara and incorporated Cities entered into an Agreement with the City of San Jose entitled AGREEMENT TO PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM (CAL-ID System) to fund, implement, and operate a local automated fmgerprint identification system, which will provide local law enforcement agencies with direct access to the local remote access network equipment; WHEREAS, on May 20, 1997, the County of Santa Clara and the City of San Jose entered into an Agreement entitled MEMORANDUM OF UNDERSTANDING REGARDING THE ACQUISITION AND OPERATION OF THE AUTOMATED FINGERPRINT IDENTIFICATION SYSTEM (AFIS); WHEREAS, on November 20, 2001, the City Council adopted Resolution Number 9951 amending the original CAL- ID Agreement, authorized the City Manager to execute future amendments, and allowed Staff to incorporate future annual renewal expenses into the corresponding fiscal year's budget; WHEREAS, on January 24, 2002, the CAL-ID/Remote Access Network Policy Board moved to approve the City of San Jose-sponsored Memorandum of Understanding between the County of Santa Clara, and incorporated Cities to combine the CAL-ID and AFIS programs, and agreed to proportionally share the costs of the CAL-ID/AFIS program among all participating jurisdictions based upon the population figures published by the State of California Department of Finance Population Estimates; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAMPBELL THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE THE MEMORANDUM OF UNDERSTANDING REGARDING THE OPERATION OF THE AUTOMATED FINGERPRINT IDENTIFICATION SYSTEM AND TO PROVIDE LOCAL LAW ENFORCEMENT AGENCIES ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM AND AUTHORIZE THE CITY MANAGER TO EXECUTE FUTURE AMENDMENTS AND/OR AGREEMENTS, AND TO AUTHORIZE STAFF TO INCORPORATE THE PROGRAM'S ANNUAL RENEWAL EXPENSES INTO THE APPROPRIATE FISCAL YEAR'S BUDGET, a copy of said Agreement is attached hereto as Exhibit 1.
