RESOLUTION NO. 10028
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
CERTIFYING THE NEGATIVE DECLARATION FOR THE PROPOSED
RECONFIGURA TION OF THE CURTNER A VENUEIMcGLINCY LANE
INTERSECTION AND AUTHORIZING THE REMOVAL OF THE CURTNER
A VENUElMcGLINCY LANE ISLAND
RESOLVED, by the City of Campbell City Council that:
WHEREAS, the Supplemental Draft Environmental Impact Report of the Winchester
Drive-In Site Project proposed a reconfiguration of the Curtner Avenue/McGlincy Lane
intersection that would mitigate traffic impacts to this intersection and discourage cut-through
traffic on Curtner A venue; and
WHEREAS, the Conditions of Approval for the Campbell Technology Park
development, adopted by the City Council on November 18, 1997, included the installation of a
median island on the east leg of Curtner A venue to prohibit southbound left turns from McGlincy
onto eastbound Curtner A venue; and
WHEREAS, in early June, 2000, the median island was constructed In a manner
consistent with the adopted conditions of approval; and
WHEREAS, the island has resulted in cut-through traffic on the Gardenland Power
Equipment property located at 196 Curtner Avenue in Campbell; and
WHEREAS, the traffic cutting through the Gardenland Power Equipment property
unduly impacts private property and creates potential traffic hazards rendering
the reconfiguration of the Curtner A venue/McGlincy Lane intersection proposed in the
Supplemental Environmental Impact Report for the Winchester Drive-In Project infeasible; and
WHEREAS, the City of Campbell has prepared an Initial Study of the Reconfiguration of
the Curtner A venue/McGlincy Lane Intersection (Project); and
WHEREAS, the Negative Declaration is made in compliance with the California
Environmental Quality Act ("CEQA", Public Resources Code Section 21000 et seq., with
particular reference to Sections 15092 and 15093); and
WHEREAS, the Project consists of the removal of the median island installed on the east
leg of Curtner A venue; and
WHEREAS, the Community Development Department staff has prepared an Initial Study
to evaluate the potential environmental impacts of the proposed Project; and
WHEREAS, the Initial Study for the Reconfiguration of the Curtner A venue/McGlincy
Lane Intersection found that the Project would result in less-than-significant impacts to the
environment; and
WHEREAS, the intersection reconfiguration would eliminate cut-through traffic on
Gardenland property and restore full access to all turning movements at the Curtner
A venue/McGlincy Lane intersection, including southbound left-turns from McGlincy Lane to
Curtner A venue; and
WHEREAS, the record (the "Record") of the City Council relating to the Project and this
Negative Declaration includes:
1. The Initial Study prepared by the Community Development Department, dated April
5, 2002;
2. The Transportation Impact Analysis Report prepared by the Public Works
Department, dated March, 2002;
3. Documentary and oral evidence received by the City Council during public hearings
and meetings on the Project.
4. The Staff Report on the Reconfiguration of the Curtner A venue/McGlincy Lane
Intersection and the accompanying resolutions, findings, and related documents.
5. Evidence presented to the City Council.
6. Matters of common knowledge to the City Council, which they have considered, such
as the Winchester Drive-In Site Project Supplemental Environmental Impact Report
dated October, 1996, and prior resolutions of the City.
WHEREAS, the City Council has fully considered the discussion and analysis in the
Record regarding the environmental impacts and socioeconomic effects of the Project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
finds that the above recitals and the information contained in the Initial Study are accurate.
BET IT FURTHER RESOLVED that the City Council of the City of Campbell adopts the
Negative Declaration for the Reconfiguration of the Curtner Avenue/McGlincy Lane Intersection
and approves the removal of the median island at the Curtner A venue/McGlincy Lane
in tersecti on.
BE IT FURTHER RESOLVED that the City Council of the City of Campbell authorizes
the Public Works Director to advertise and call for informal bids for the removal of the Curtner
A venue/McGlincy Lane median island and to award a contract to the lowest responsible bidder.

FINDINGS FOR CERTIFICATION OF A NEGA TIVE DECLARATION FOR THE
RECONFIGURA TION OF THE CURTNER A VENUE/McGLINCY LANE INTERSECTION
The City Council finds as follows with regards to the Reconfiguration of the Curtner
A venue/McGlincy Lane Intersection (Project):
1. The Campbell Public Works Department prepared a transportation impact analysis report to
evaluate the potential impacts of the reconfiguration of the Curtner A venue/McGlincy Lane
intersection and found that traffic conditions at this intersection have changed such that the
reconfiguration would result in less-than-significant traffic impacts.
2. The Campbell Community Development Department prepared an Initial Study that evaluated
the environmental impacts of the reconfiguration of the Curtner A venue/McGlincy Lane
intersection.
3. The Initial Study has been expressly prepared to serve as the CEQA document for City
Council consideration of the reconfiguration of the Curtner Avenue/McGlincy Lane
intersection.
4. The Initial Study has been completed in compliance with CEQA, the State CEQA Guidelines,
and the Local CEQA Implementing Guidelines.
5. The City Council has read the Initial Study and finds that they adequately address the
environmental issues of the reconfiguration of the Curtner A venue/McGlincy Lane
intersection.
6. Notice of the availability of the Initial Study was prepared and published pursuant to Section
21092 of the Public Resources Code, advising the public that a 20-day public review period
would end on May 1, 2002.
7. The City Council hereby finds and determines that the Initial Study for the reconfiguration of
the Curtner A venue/McGlincy Lane intersection reflects independent judgment of the City
Council.
8. As detailed in the Initial Study, approval and implementation of the Project will not result in
significant impacts to the environment.
9. Based on the information set forth in the Initial Study, the City Council finds pursuant to 14
California Code of Regulations Section 753.5@ that, considering the record as a whole,
approval and implementation of the Project involves no adverse effect, either individually or
cumulatively, on vegetation or wildlife, and that therefore no fee is required in connection
with the filing of a Negative Declaration.
