CC Resolution 10034 RESOLUL TION NO. 10034 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL SUMMARIL Y VACATING EXCESS PUBLIC STREET RIGHT -OF-WAY ALONG 723 EL PATIO DRIVE AND AT THE EASTERLY END OF EL PATIO DRIVE, AUTHORIZING THE PUBLIC WORKS DIRECTOR TO SIGN QUITCLAIM DEEDS, AND AUTHORIZING THE PUBLIC WORKS DIRECTOR TO NEGOTIATE A REIMBURSEMENT AGREEMENT FOR CONSTRUCTION OF CERTAIN STREET IMPROVEMENTS WHEREAS, at a regular meeting on October 6, 1998, the City Council authorized staff to initiate the process for vacation of excess public street right-of-way for property located on El Patio Drive; and, WHEREAS, the vacation is to be made pursuant to Chapter 4, Summary Vacation, of Part 3 of Division 9 of the California Streets and Highway Code; and, WHEREAS, the property to be vacated constitutes excess right-of-way not required for street or highway purposes; and, WHERE, legal descriptions and a plat depicting the excess public street right-of-way to be vacated are correctly described in Exhibits A, B, and C attached to this Resolution. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Campbell hereby vacates excess public street right-of-way along 723 EI Patio Drive as described in Exhibit A attached reserving easements for all existing utilities, a public utility easement, a public service easement, a Santa Clara Valley Water District access easement, and a future creek trail easement; and BE IT FURTHER RESOL VED that the City Council of the City of Campbell hereby vacates excess public street right-of-way at the easterly end of EI Patio Drive as described in Exhibit B attached reserving easements for all existing utilities, a public utility easement, a public service easement, and a future creek trail easement; and, BE IT FURTHER RESOLVED that the City Council of the City of Campbell hereby authorizes the Public Works Director to sign quitclaim deeds to the owners of 723 EI Patio Drive for the property described in Exhibit A attached and to Santa Clara Valley Water District for the property described in Exhibit B attached; and, BE IT FURTHER RESOL VED that the City Council of the City of Campbell hereby authorizes the Public Works Director to negotiate a Reimbursement Agreement for construction of certain street improvements along the south side ofEI Patio Drive east of Poplar Avenue.
