A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
REJECTING ALL BIDS FOR THE COMMUNITY CENTER MASTER PLAN
IMPROVEMENT PROJECT 99-05 AND AUTHORIZING THE RE-ADVERTISEMENT
AND RE-SOLICIT A TION OF BIDS AND AUTHORIZING THE PUBLIC WORKS
DIRECTOR TO EXECUTE AN AMENDMENT TO THE CONSULTANT SERVICES
AGREEMENT WITH MPA DESIGN IN AN AMOUNT NOT TO EXCEED $75,000
WHEREAS, on April 16, 2002, the City Council approved the plans and specifications
for the Community Center Master Plan Improvements; and
WHEREAS, bids for the project were received on June 11,2002; and
WHEREAS, Robert A. Bothman has indicated that legal remedies would be
contemplated should the contract be awarded based on their claim that an addendum issued
within 72 hours of the bid opening did have a substantial cost impact on their bid and placed
Robert A. Bothman at a competitive disadvantage in the bid process; and
WHEREAS, additional revisions to the master plan and the plans and specifications
required additional design services by MPA Design.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby rejects all bids submitted for Project 99-05 Community Center Master Plan
Improvements and authorizes the re-advertisement and re-solicitation of bids for the project;
and authorizes the Public Works Director to execute a second amendment to the Consultant
Services Agreement with MPA Design in an amount not to exceed $75,000
