PC Res 3276RESOLUTION NO. 3276 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL GRANTING A FENCE EXCEPTION (PLN2000-40) TO ALLOW A SEVEN FOOT HIGH FENCE (SIX FOOT SOLID FENCE WITH ONE FOOT LATTICE) AND A REDUCED CORNER SETBACK FOR THE PLACEMENT OF SAID FENCE ON PROPERTY LOCATED AT 96 DEL PRADO DRIVE IN AN R-l-6 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF KEN AND SUE SCHWANDA. FILE NO. PLN2000-40. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2000-40. 1. The subject fence is six-feet along the rear property line and seven-feet from the street side above the existing grade of the subject property. 2. The subject fence is constructed of quality materials and enhances the appearance of the subject property. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The requested fence exception does not impair pedestrian or vehicular safety. 2. The requested fence exception results in a more desirable layout of the applicant's property. o The establishment, maintenance, and/or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvement in the neighborhood or to the general welfare of the City. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the ordinance of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition where necessary. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified: Planning Commission Resolution No. 3276 PLN2000-40 - 96 Del Prado Drive - Fence Exception - Ken & Sue Schwanda Page 2 Approved Project: A fence exception is granted for the property located at 96 Del Prado Drive to allow a seven-foot redwood fence at the street-side property line (six inches behind the existing sidewalk) and six-feet along the rear property line. Project approval shall substantially comply with the applicant's project plans dated March 20, 2000 except as modified herein. Building Permits: The applicant shall obtain all necessary building permits and clearances from the Building Division for the fence approved under the PLN 2000-40. Prior to constructing the fence, the applicant shall submit building plans to the Building Division.
