CC Resolution 9979 4- RESOLU'l'ION NO. 9979 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE CAMPISI WAY BRIDGE AND EXTENSION PROJECT 96-19 After notification and public hearing, as specified by law the City Council did determine that the adoption of a Mitigated Negative Declaration is warranted based upon the following findings: 1. An Initial Study has been prepared for the City of Campbell Campisi Way Bridge and Extension Project 96-19, which provides documentation for the factual basis for concluding that a Mitigated Negative Declaration may be prepared since no substantial evidence exists, in light of the whole record, that the Campisi Way Bridge and Extension Project may have a significant effect on the environment. 2. RFB Consulting of San Jose, California, prepared an Initial Study to evaluate the potential impacts of the Campisi Way Bridge and Extension Project and found that the proposed project would not have a significant impact on the environment. 3. A Mitigated Negative Declaration that describes the reasons that the Campisi Way Bridge and Extension Project 96-19 will not have a significant effect on the environment and therefore does not require the preparation of an Environmental Impact Report was prepared pursuant to Section 15071 of the California Environmental Quality Act Guidelines. 4. There are no responsible agencies or trustee agencies responsible for resources affected by the Campisi Way Bridge and Extension Project 96-19. 5. The City of Campbell provided a notice of intent to adopt a Mitigated Negative Declaration to the public via the Campbell Express and the County Clerk. 6. The City of Campbell provided a 20 day public review period of the Mitigated Negative Declaration pursuant to Section 15073 of the California Environmental Quality Act Guidelines. 7. The City Council hereby finds and determines that the Mitigated Negative Declaration reflects the independent judgment of the City Council. Based upon the foregoing findings of fact, the City Council further finds and concludes that: 1. No substantial evidence has been presented which shows that the Campisi Way Bridge and Extension Project 96-19 as currently presented would have a significant effect on the environment. 2. The Custodian of the Record for this Mitigated Negative Declaration and Initial Study is the City Clerk of the City of Campbell, located at 70 North First Street, Campbell, California. .. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Campbell that a Mitigated Negative Declaration is hereby adopted for the Campisi Way Bridge and Extension Project 96-19.
