A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL ACCEPTING THE ANNUAL STATUS REPORT ON
PROJECT DEVELOPMENT FEES (AB-1600)
WHEREAS, Government Code Section 66001(d) requires the City to make findings once
every five fiscal years with respect to any portion of a fee remaining unexpended in its account
five or more years after deposit of the fee, and to identify the purpose to which the fee is to be put
and to demonstrate a reasonable relationship between the fee and the purpose for which it was
charged; and
WHEREAS, the City of Campbell elects to do an annual AB-1600 status report; and
WHEREAS, staff, under Government Code Section 66001(d), has reviewed the
development fees collected between January 1, 1989 (the date when this requirement became
effective) and June 30, 1996 to determine if any such development fees remain unexpended; and
WHEREAS, staff has found that $22,151 in Storm Drain project development fees and
$334,596 in Park Dedication project development fees collected between January 1, 1989 and
June 30, 1996 remain unexpended; and
WHEREAS, staff has set forth the information required by California Government Code
Section 66006 in the report and attachments accompanying this resolution.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Campbell
that the following findings are hereby made regarding the amount of fees that remain
unexpended:
1. The purpose of the Storm Drain project development fees is to provide storm drain
improvements to offset the increased run-off caused by the new development;
2. The purpose of the Park Dedication project development fees is to provide for park
improvements and acquisitions to serve the residents of residential developments;
3. There is a reasonable relationship between the Storm Drain project development fees
and the purpose for which the fees are charged, in that development of real property
increases the impervious surface of the land resulting in increased run-off and an
increased need for storm drainage;
4. There is a reasonable relationship between the Park Dedication project development
fees and the purpose for which the fees are charged, in that residential development
adds additional residents to the City, thereby increasing the demand on the City's
parks and recreational facilities;
5. The sources and amounts of funding anticipated to complete financing in incomplete
improvements for which the Storm Drain project development fees were collected are
as follows: Campisi Way project-Storm Drain fees--$130,000; Capital
Improvement Plan Reserve--$826,779; Local Improvement District Reserve--
$28,221; Gas Tax funds--$180,000; Construction Tax funds--$182,000; Private
funds--$700,000; McGlincey/Cristich Storm Drain project-Storm Drain fees--
$320,000; Redevelopment funds--$185,500.
6. The sources and amounts of funding anticipated to complete financing in incomplete
improvements for which the Park Dedication project development fees were collected
are as follows: Morgan Park Phase II project-Park Dedication fees--$830,000;
Community Center Master Plan Improvements project-Park Dedication fees--
$3,470,000; Open Space Reserve--$930,000; City and Redevelopment Agency
Certificate of Participation funds--$1,062,000.
7. Funding to complete financing in incomplete improvements for which the Storm
Drain project development fees were collected have been deposited into the
appropriate account as of June 30, 2001 with the exception of the private funding for
which date of collection cannot be estimated at this time;
8. Funding to complete financing in incomplete improvements for which the Park
Dedication project development fees were collected have been deposited into the
appropriate account or fund as ofJune 30, 2001;
9. The improvements for which the unexpended Storm Drain project development fees
remain unexpended for the Campisi Way project will commence construction on or
by approximately March, 2002 and for the McGlincey/Cristich Storm Drain project
on or by approximately May, 2002;
10. The improvements for which the unexpended Storm Drain project development fees
remain unexpended for the Morgan Park Phase II project will commence construction
on or by approximately June, 2002 and for the Community Center Master Plan
Improvements on or by approximately July, 2002.
NOW, THEREFORE, BE IT FURTHER RESOLVED, by the City Council of the City of
Campbell that Council review, accept and file this Annual Status Report on project development
fees as stipulated under Government Code Section 66000 et seq.
