CC Resolution 9962 RESOLUTION NO. 9962 RESOLUTION AUTHORIZING THE EXTENSION OF THE SANTA CLARA COUNTY ABANDONED VEHICLE ABATEMENT SERVICE AUTHORITY AGREEMENT WHEREAS, California Vehicle Code Sections 9250.7 and 22710 provide for the establishment of an abandoned vehicle service authority for the purpose removal and disposal of abandoned vehicles; and, WHEREAS, in 1991, the County of Santa Clara, the Cities of Campbell, Cupertino, Gilroy, Los Altos, Los Altos Hills, Milpitas, Monte Sereno, Morgan Hill, Mountain View, Palo Alto, San Jose, Santa Clara, Saratoga, Sunnyvale, and the Town of Los Gatos created the Santa Clara County Abandoned Vehicle Abatement Service Authority (A VASA) by adoption of a resolution in each local jurisdiction and entrance into a written agreement; and, WHEREAS, funding for AVASA, as authorized under California Vehicle code Section 9250.7, was scheduled to expire on April 30, 2002, at which time AVASA would cease to exist; and, WHEREAS, Section 9250.7 of the California Vehicle Code as amended by Senate Bill 106 authorizes the continued collection of the abandoned vehicle abatement fee over increments of time up to 10 years if the County Board of Supervisors, by a two- thirds vote, and a majority of the cities having a majority of the incorporated population within the county adopt resolutions providing for continued collection of the fee. NOW, THEREFORE, BE IT RESOLVED, that City Council of the City of Campbell authorizes continued collection of the abandoned vehicle abatement fee and participation in A VASA for the period of time beginning May 1, 2002 through May 1, 2012; and, BE IT FURTHER RESOLVED, that the City Manager of the City of Campbell is authorized to execute a renewed or amended agreement to continue the City's participation in A VASA.
