A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AND THE
CAMPBELL REDEVELOPMENT AGENCY BOARD
APPROVING THE SANTA CLARA COUNTY PROPERTY TAX ALLOCATION
SETTLEMENT AGREEMENT AND MUTUAL RELEASE
WHEREAS, the County of Santa Clara is required pursuant to California State Law to
collect and apportion property taxes to various cities, school districts, fire districts and other
local agencies located within the County, and;
WHEREAS, the County of Santa Clara has completed a multi-year internal review and
recalculation of its property tax apportionment from FY 88/99 through FY 99/00, which
revealed that the County overpaid some agencies and made equal aggregate underpayments to
others, and
WHEREAS, the County of Santa Clara and all affected agencies and jurisdictions
participated in comprehensive review of this matter and, by consensus, proposed a global
settlement agreement and mutual release approach involving forgiving repayment of some
jurisdictions' overpayments, and the County paying some jurisdictions that were underpaid,
provided they agree to accept less than full recovery pursuant to the Settlement Agreement and
Mutual Release;
NOW, THEREFORE BE IT RESOLVED, that the Santa Clara County Property Tax
Allocation Settlement Agreement and Mutual Release be approved and that staff be directed to
proceed with finalizing the agreement and release as required.
