RESOLUTION NO. 9894
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL AUTHORIZING THE PUBLIC WORKS DIRECTOR
TO EXECUTE AN AGREEMENT WITH ROGER DEAN CUMMINGS
FOR CONSTRUCTION AND REIMBURSEMENT OF SPECIFIED
STREET IMPROVEMENTS ON THE NORTHWEST CORNER OF
CIVIC CENTER DRIVE AND NORTH FIRST STREET
WHEREAS, on March 21, 2000, the City Council of the City of Campbell
approved PLN 1999-22 to allow the conversion of an existing residential use into an
office use at the northwest corner of Civic Center Drive and North First Street; and,
WHEREAS, conditions placed on this approval require the applicant to design
and construct street improvements on the property's Civic Center Drive and North First
Street frontages; and,
WHEREAS, a street improvement agreement has been entered into and an
encroachment permit obtained for the design and construction of said improvements; and,
WHEREAS, the removal of an existing traffic barrier and removal and
replacement of the adjacent sidewalk and pedestrian ramp was recommended by staff as
part of the off site street improvements; and,
WHEREAS, staff has reviewed the contractual prices for the off site street
improvements and recommends reimbursement to the Developer of the cost of the traffic
barrier removal and adjacent sidewalk and pedestrian ramp removal and replacement in
an amount not to exceed $8,500.00; and,
WHEREAS, funds are available from Project 02- 72, Annual Sidewalk
Maintenance, which is currently allocated in the operating budget.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby authorize the Public Works Director to execute a Street
Improvement and Reimbursement Agreement with Roger Dean Cummings for the
design, construction and reimbursement of off site street improvements at the northwest
corner of Civic Center Drive and North First Street as specified in said agreement.
