RESOLUTION NO. 9873
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CAMPBELL TO APPROVE
ISSUANCE OF SPECIAL EVENT PERMIT FOR
PROJECT MATCH LUAU BLOCK PARTY
WHEREAS, the City Council finds, as follows, with regard to the present
application for a Special Events Permit:
1. The purpose of this event is to raise money in support of Project Match's Senior
Group Residence Program, by having a Luau style Block party on Fairlands
Court;
2. Vehicle access will be blocked off to six residents at Fairlands Court. Access to
emergency vehicles will be allowed;
3. A licensed caterer will supply food; and
4. All laws applicable by the Alcoholic Beverage Control will be adhered to.
Based on the foregoing findings of fact, the City Council further finds and concludes:
Per Section 5.50.050 of the Campbell Municipal Code:
a) The special event will not disrupt to an unreasonable extent the movement of
other traffic or create any safety hazard as a result of such other traffic being
stopped or diverted;
b) Sufficient security can be provided to assure proper traffic control and the
orderly conduct of the special event;
c) The streets, roads, and highways over which the special event will travel or on
which it will be conducted are of sufficient size and construction to safely
accommodate the number of participants and the size, height, and weight of any
vehicles, floats, equipment or animals participating in the event:
d) The special event will not interfere with any other public events to be conducted
on the same day;
e) The special event is not likely to cause injury to persons or property or create an
unreasonable disturbance of the peace;
t) The cumulative impact of other previous special events would not create an
undue strain on public resources.
NOW, THEREFORE, BE IT RESOLVED that the Campbell City Council grant
the Special Event permit subject to the following conditions:
1. The applicant agrees to be responsible for set-up and clean-up of any and all
public right of ways;
2. The applicants agree to provide their own security;
3. The applicant agrees that no food, beverages, alcoholic beverages, or any other
items will be sold at the event for profit; and
4. The applicant possesses and has provided to the Campbell Police Department,
prior to the event, a Certificate of Insurance that on behalf of the applicant(s)
their heirs, assigns, and legal representatives which releases the City of
Campbell, the Campbell Redevelopment Agency, its officers, employees, and
agents from any liability whatsoever arising out of their participation in or
presence at the above-described activity. They further agree to expressly absolve
the City of Campbell, the Campbell Redevelopment Agency, their officers,
employees, and agents of liability for their negligence.
