PC Res 3287RESOLUTION NO. 3287 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING AN EXTENSION (PLN2000-91) OF A PREVIOUSLY-APPROVED MODIFICATION TO A CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED USE OF A PORTABLE CLASSROOM FOR MULBERRY SCHOOL ON PROPERTY LOCATED AT 1980 HAMILTON AVENUE IN A PF (PUBLIC FACILITIES) ZONING DISTRICT. APPLICATION OF MS. RUTH KAPLAN. FILE NO. PLN2000-91. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application PLN2000-91: There is adequate parking on-site to accommodate the proposed use based upon the staggered use of the site by the church and school uses. The proposed use of the two modular buildings for additional classroom space is consistent with the existing uses on the property. o The proposed double modular building is set back 10 feet from the eastern property line and approximately 180 feet from the southern property line to provide sufficient distance from the nearest residential uses. One portable classroom has been on the property since 1993, and the other portable classroom has been on the property since 1996 without causing any reported parking or noise issues. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: The extension of the use permit for portable classrooms will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the yards, wall fences, parking and loading facilities, landscaping and other development features required in order to integrate said use with uses in the surrounding area.
