RESOLUTION NO. 10792
BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL AUTHORIZING THE DESTRUCTION OF CERTAIN CITY
RECORDS
WHEREAS, Government Code Section 34090 and California Department of
Justice Guidelines authorize City department heads to destroy certain records,
documents, instruments, books, or papers, after they are no longer required, with
the approval of the legislative body by Resolution and written consent of the City
Attorney; and
WHEREAS, the City Council proposes to grant such approval for the destruction
of the records, documents, instruments, books or papers as described in Exhibits
A. B, and C attached hereto, it having been determined by the Chief of Police
that these records are no longer required.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Campbell that does hereby authorize the Chief of Police to destroy these
records, documents, instruments, books or papers under their charge.

CITIZEN COMPLAINT FILE DESTRUCTION
Section 832.5 of the Penal Code requires law enforcement agencies to retain records of
City Complaints for at least five years. This period has lapsed for the following Citizen
Complaint files:
#2001-01 through 2001-08 filed between January 1 and December 31,2001

TRAFFIC COLLISION REPORT
FILE DESTRUCTION
Section 34090 of the Government Code requires law enforcement agencies to retain
Traffic Collision Report records for two years. This period has lapsed for the Traffic
Collision Report files as shown on Exhibit C attached.
