CC Resolution 9817 RESOLUTION NO. 9817 OF THE CITY COUNCIL OF THE CITY OF CAMPBEL RESOLUTION APPROVING THE ADOPTION OF THE CALIFORNIA HIGHWAY PATROL ROTATION TOW RATE REGULATION PROCESS WHEREAS, the Chief of Police has been presented with a pr posal for adoption of the San Jose Office of the California Highway Patrol (C P) rotation tow rate regulation process; and WHEREAS, the Chief of Police finds that the CHP rotation to rate regulation process is equitable for tow companies and customers; a d WHEREAS, Sections 5.44.020 and 5.44.030 of the Campbell Municipal Code require City Council approval of tow company rate schedules. NOW THEREFORE, BE IT RESOLVED that the CHP San Jo e Office rotation tow rates are hereby approved for adoption by the Police D partment. Class A trucks are suitable for towing passenger y hicles, boat trailers, and other vehicles weighing up to 8,000 pounds. Labor Rate: Inside Storage: Outside Storage: $116 per hour $37 per day $34 per day Class B - Medium Duty - Tow trucks with a gross vehicle weight ring of at least 19,501 pounds, equipped with air brakes and a tractor protecti n valve or device and capable of providing and maintaining continuous air to t e towed vehicle. Class B trucks are suitable for towing light-duty commercia trucks, small buses, and other vehicles weighing up to 26,000 pounds. Labor Rate: Inside Storage: Outside Storage: $169 per hour $34 per day $33 per day Class C - Heavy Duty - Three-axle tow trucks with a gross vehicle weight rating of at least 33,000 pounds, equipped with air brakes and capable of roviding and maintaining continuous air to the towed vehicle. Class C trucks are suitable for towing semi-tractors, trailers up to 40' in length, large bob-tail truck , and other vehicles weighing more than 26,000 pounds. Labor Rate: Inside Storage: Outside Storage: $257 per hour $34 per day $33 per day Class D - Super Heavy Duty - Three-axle tow trucks with a gross ehicle weight rating of more than 50,000 pounds, equipped with air brakes and pable of providing and maintaining continuous air to the towed vehicle. Cia s D trucks are suitable for towing cement mixers, garbage trucks, and performi g salvage and recovery operations. Labor Rate: Inside Storage: Outside Storage: $288 per hour $35 per day $34 per day Applicable Campbell Municipal Code Sections (Bold text used to highlight relevant material.) 5.44.020 Notice required. All owners and/or associations of owners, owning, leasing, controlling and sing lands reserved for the parking of motor vehicles by their customers, patron and business invitees shall place and erect appropriate signs giving notice that parking is limited to such customers, patrons and business invitees, and that unaut orized parking by others will subject the removal of their motor vehicles at registe ed owner's cost and expense, and in accordance with established towing ates approved by the city council and on file at both the office of the city c erk and the chief of police. The signs shall comply with municipal code provision . (Prior code S6531). 5.44.030 Application for tow car operator's permit. Applications for tow car operator's permit issued under this chapter shall b filed with the chief of police and shall contain the following information: (1) The type of ownership of the tow car business, i.e., whether individual, partnership, corporation, etc.; (2) The names, addresses of the owners of the business and if such owner is a corporation, of the officers of such corporation; (3) The name and style under which the business is to be conducted; (4) The business address and telephone number of the business; (5) The names and residence addresses of all employees of the business nature of their employment; (6) A schedule of rates to be charged for towing services, which rates hall be approved by the city council; (7) Such other information as the chief of police deems necessary in conn with the application, including violations of law; (8) An application processing fee as set by city council resolution shall be aid per Section 5.08.020, and at the time of issuance, a business license fee of fift -five dollars shall be paid to the city clerk.
