RESOLUTION NO. 9788
BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL DENYING AN APPEAL AND
UPHOLDING THE PARKS AND RECREATION COMMISSION
CONDITIONS OF APPROVAL TO REMOVE THE
STREET TREE AT 1117 ARCHER WAY
Based on the evidence presented, the City Council did find as follows with respect
to the application for tree removal at 1117 Archer Way:
1. The female ginko street tree located in the parkway in front of 1117 Archer Way
drops odorous fruit on the sidewalk.
2. Tree removals approved for the convenience of the applicant have consistently
been conditioned upon the applicant bearing the expense of removal and
replacement of the tree.
Based on the foregoing findings, the City Council further finds and concludes as
follows:
1. The fruit does not cause undue inconvenience or undue traffic hazard.
2. The removal is for the convenience of the applicant.
PASSED AND ADOPTED this 2nd day of January, 2001, by the following roll call
vote:
