RESOLUTION NO. 9733
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AWARDING THE CONTRACT FOR PROJECT 99-13 EDITH MORLEY PARK,
TO ROBERT A. BOTHMAN, INC., IN THE AMOUNT OF $1,009,136;
ENCUMBERING $100,914 AS A 10% CONTINGENCY AND AUTHORIZING THE
PUBLIC WORKS DIRECTOR TO EXECUTE THE CONTRACT
WHEREAS, bids were received for construction of Project 99-13, Edith Morley Park,
on August 30, 2000; and
WHEREAS, Robert A. Bothman, Inc. has been found to be the lowest responsible
bidder with a total bid of $1,009,136; and
WHEREAS, a minor irregularity was found in the bid proposal by Robert A. Bothman,
but was determined not to affect the integrity of the bid proposal; and
WHEREAS, specialty inspection and construction administration services for this
project are recommended, and Singer and Fukushima, Landscape Architects, have proposed to
complete these additional services for an amount not to exceed $26,000; and
WHEREAS, additional revenues of $75,000 are anticipated to be awarded to this
project by the State of California Department of Parks and Recreation in the form of Land and
Water Conservation Grant funding; and
WHEREAS, additional revenues of $25,474 are anticipated as a contribution to the
project from the Santa Clara Valley Water District; and
WHEREAS, additional revenues of $119,241 are anticipated as a contribution to the
project from the Santa Clara Valley Open Space Authority; and
WHEREAS, the adopted Fiscal Year 00/01 Capital Improvement Program approved
funding of $434,000 for improvements on the former Winchester Drive In site, and
WHEREAS, the attached budget adjustment has been prepared to reflect these project
revenues and additional funding;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell hereby waives the minor discrepancy in the bid proposal and awards the construction
contract for Edith Morley Park (Project 99-13) to Robert A. Bothman Inc., in the amount of
$1,009,136, and that $100,914 be encumbered as a 10 % construction contingency for a total
amount of $1,110,050, and that the Public Works Director is hereby authorized to execute an
agreement with Robert A. Bothman, Inc. for construction of Project 99-13.

BE IT FURTHER RESOLVED that the Public Works Director is authorized to execute
a contract with Singer and Fukushima, Landscape Architects, for construction inspection and
administration services in an amount not to exceed $26,000 and that the attached budget
adjustment is hereby approved.
