Maintenance Bond Amount: $4,200.00
Gentlemen:
We have made a Final Inspection of subject public works construction and find it
acceptable and in conformance with City standards. Accordingly, we have recom-
mended the acceptance of the work to the City Council. We will send a copy of their
resolution accepting the work upon their approval of same.
You are responsible for the maintenance, repair and/or replacement of all work done
should any failures occur within one (1) year of this date. To guarantee this,
you must either post a maintenance bond in the amount indicated above, or maintain
your existing Faithful Performance Bond. If you post a separate maintenance bond,
your current bond will be released by separate action.
We will inspect the work in one year and advise you whether or not maintenance is
needed.

BEING A RESOLUTION ACCEPTING TRACT
NO. 6670 AND IMPROVEMENTS THEREON
WHEREAS, the City Council has been advised by the City Engineer that
all improvements in Tract No. 6670 have been completed in accordance with
that agreement entered into July 30, 1979, concerning said Tract; and,
WHEREAS, the City Engineer recommends acceptance of the Tract and im-
provements;
NOW, THEREFORE, BE IT RESOLVED by the City Council that Tract No. 6670,
together with al I improvements thereon, be and the same are hereby accepted,
and that the City Engineer is hereby ordered to record a Notice of Comple-
tion of said improvements.

RESOLUTION NO. 5828
BEING A RESOLUTION OF INTENTION OF THE CITY COUNCIL, CITY
OF CAMPBELL, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA,
TO VACATE A PORTION OF THAT CERTAIN PUBLIC SERVICE EASE-
MENT WITHIN TRACT NO. 6670 AND SETTING TIME AND PLACE FOR
THE HEARING THEREON AND GIVING NOTICE THEREOF
WHEREAS, the City of Campbell did, by virtue of that certain map of Tract
No. 6670, filed August 16, 1979, in Book 447 of Maps at page 46, in the office
of the County Recorder of said County, acquire that certain public service
easement, a map of which together with a description thereof is on file in the
office of the City Clerk of said City of Campbell, located at City Hall, 75
North Central Avenue, Campbell, Cal ifornia; and,
WHEREAS, the City Council of said City of Campbell does find, determine
and affirm that said portion of said public service easement lying within said
lot has not been used for the purpose for which it was dedicated; and
WHEREAS, said City Council does find, determine and affirm that said
position of said easement is not necessary for any present or prospective
public uses; and,
WHEREAS, said City Council does hereby elect to proceed in accordance
with the provisions of the Public Service Easement Vacation Law of the State
of California, namely, Title 5, Division 1, Part 1, Chapter 2, Article 5,
Section 50430, et sequens, of the Government Code of the State of
Cal ifornia;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CAMPBELL DOES ORDAIN AS
FOLLOWS:
SECTION ONE: That it is the intention of the City Council of the City of
Campbell to vacate, abandon and close to public uses that
certain portion of that certain public service easement, a
description of which, together with map thereof, is on file
in the office of the City Clerk of the City of Campbell, at
City Hall, 75 North Central Avenue, Campbell, California.
SECTION TWO: Notice is hereby given that t1onday, July 28, 1980, at the
hour of 8:00 olc1ock p.m. of said day, in the City Council
Chambers in the City Hall, 75 North Central Avenue, Campbell,
California, is hereby fixed as the time and the place for
hearing all persons interested in or having objections to
the proposed vacation.
SECTION THREE: IT IS HEREBY ORDERED AND DIRECTED that a notice of the
passage of this Resolution of Intention be forthwith pub-
lished twice, once each week, for two (2) successive weeks,
which latter publication shall be made not less than ten
(10) days prior to the date of the hearing, in the Campbell
Press, a newspaper of general circulation, printed and pub-
I ished in said City of Campbell, and that notices of said
easement vacations be posted conspicuously along the 1 ines
of the portion of the easement proposed to be vacated at
least ten (10) days prior to the date set for the hearing.
Said notices shall be posted not more than three hundred
(300) feet apart, but at least three (3) such notices shall
be posted for each portion. Said notices shall state the
passage of this Resolution of Intention and notify of the
time, date and place of the hearing on the proposed vacation.
SECTION FOUR: That the following is the description of the portion of the
public service easement which is proposed to be vacated:

Dear Mr. Krandel:
We are responding to your letter of April 21 regarding the construction
of improvements at subject location. Please be aware that our inspector
talked to your tract superintendent on March 31 regarding the need to
install these improvements. We are sorry the requirement for improve-
ments comes as a shock.
Please consider this letter as notification that complete street im-
provements are to be installed across the entire frontage of subject
tract. This notice is as required and provided for in Agreement,
No. McGlincey (McG.)43 between Apricot lane Associates and the City
of Campbell (a copy enclosed).
The standard requirement on a development such as this that has public
works improvements is to hold the release on the last ten (lOX) per cent
of the units until the public works improvements are completed. Even
these units will be released if the developer deposits a cash amount
equal to the engineer's estimated value of the improvements to be com-
pleted.
We are personally working with your engineer, Mr. Roger Lehr, on his
preparation of his construction plans. It appears that the street con-
struction can and will proceed very quickly.

Dear Mr. Elliott:
We are in receipt of your letter dated April 17, 1980, signed by
David Valkenaar, with regard to construction at 905 Apricot avenue.
This letter refers to an "Agreerrent", of which we neVEr received a
signed copy. Threrfore, we are at a total loss as to what the
agreerrent was. However, I do recall specifically at the time of
approval of this subdivision, that the City of Canpbell decided
not to widen Apricot Avenue at that tine, and the required street
improverrents were to be deferred until a decision was reached. We
have received no official notice from you or any other Depa.rt::n:ent
regarding a change in plans. We are shocked by the almre dated
letter and sincerely hope same arrangerrents can be made whereby
we can close sales on the units we have sold, and allow buyers to
occupy the units prior to completion of the requested street work.
This project is nearing completion and our final Driveway grad-
ing and base rock is scheduled for Monday, April 21, 1980.
Any consideration you can give us in this matter would be greatly
appreciated. I would also appreciate receiving a copy of the
signed agreertEI1t referred to in the April 17th letter.

1. A CASH DEPOSIT is required. Charges will be made against this deposit if emergency call-out, overtime
inspection or City ordered barricading is required. (See General Conditions l3and 14.) Any such costs

completion of the work and written acceptance by the City.

the hours of 8 a.m. to 5 p.m. The rate is $10 per hour with a $10 minimum charge per Occurrence.
14. Adequate lighted BARRICADING is required on the jOb site. Failure to provide such barricading as specified
by the City Engineer will result in the City renting such barricades and charging the cost against the
cash depOSit.
15. Asphalt and/or compaction TESTING, if required by the City Engineer, shall be provided by Permittee.
16. The Contractor or Permittee will have a SUPERVISORY REPRESENTATIVE available for contact on the prOject
at all times during construction.
17. This permit Shall be kept at the site of work and must be shown to anv authorized representative of the
City of Campbell or any law enforcement officer upon demand.
18. No MATERIAc STORAGE will be allowed near the edge of pavement, the traveled way, or within the shoulder
line which would create a hazardous condition to the motoring public.
1,. This permit shall not be construed as authorization for excavation and grading on private property adja-
cent to the work or any other work for which a separate permit may be required, nor does it relieve the
Permittee of any obligation to obtain any other permit required by law.
20. The Permittee Shall RELOCATE, at his sole expense, the work authorized by this ,,"it, in the Ivent future
improvement of the road necessitates such relocation.
21. All necessary ROAD REPAIRS resulting from the pel"lllit work shall be ..de in accordlnce with City Standards
and Specifications at the sole expense of the Permittee.
22. This permit does NOT RELEASE the Permittee from any liabilities contained in other agreements of contracts
with the City or any other public agency.

Section 21.42.090 of the Campbell MunIcipal Code reads as follows:
Any approval granted under this section shall expire one year after thej
date upon which such approval was granted, unless an extension for such
approval is obtained by making written appl ication for same to the
Planning Commission at least fifteen (15) days prior to the expiration
date of such approval.
No building permit shall be issued after the expiration date of any app~oval
until a new approval has been obtained in the manner provided for In thl:s
Chapter.
