BEING A RESOLUTION OF THE PLANNING COMNIISSION OF
THE CITY OF CAMPBELL, STATE OF CALIFORNIA,
RECOMMENDING APPROVAL OF REINSTATEMENT OF A
PREVIOUSLY APPROVED PLANNED DEVELOPMENT PERMIT,
AND REVISED DEVELOPMENT SCHEDULE, ON PROPERTY
LOCATED AT 875 APRICOT AVENUE, IN A PD (PLANNED
DEVELOPMENT) ZONING DISTRICT. APPLICATION OF MR.
KURT ANDERSON, FILE NO. R 92-04 (PD 90-04).
After notification and Public Hearing as specified by law on the application of
Mr. Kurt Anderson, for approval of a Reinstatement of a Planned
Development, and Revised Development Schedule to allow construction of 4
townhomes, on property located at 875 Apricot Avenue, in a PD (Planned
Development) Zoning District; and, after presentation by the Planning
Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with regard to File No. R 92-04:
1. There are no changes in the General Plan or Zoning since the previous
approval.
2. Extension of the Planned Development Permit will coincide with the
expiration of the Tentative Parcel Map expiration date, and
3. No modifications to the previous approval are requested by the
applicant.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The proposed development and uses clearly would result in a more
desirable environment and use of the land than would be possible under
any other zoning classification; and
The development and uses would be compatible with the General Plan
of the City and will aid in the harmonious development of the
immediate area.
The proposed development will not result in allowing more residential
units than would be allowed by other residential zoning districts which
are consistent with the General Plan designation of the property; and

4. The proposed development would not be detrimental to the health,
safety, or welfare of the neighborhood or the City as a whole.
Based upon the above findings, the Planning Commission recommends
approval of the Reinstatement of the Planned Development Permit and
Revised Development Schedule, subject to the following Conditions of
Approval:
1. Fencing and Landscaping: Property to be fenced and landscaped as
indicated and/or added in red on the plans. Landscaping and fencing
shall be maintained in accordance with the approved plans.
2. Landscape Plan: Landscaping plan indicating type and size of plant
material, the relocation or replacement of the 3 trees along Apricot
Avenue, and location of irrigation system to be submitted to the
Planning Department and approved by the Site and Architectural
Review Committee and/or the Planning Commission prior to issuance
of a building permit.
3. Fence Plan: Fencing plan indicating location and design details of the
fencing to be submitted to the Planning Department and approved by the
Planning Director prior to issuance of a building permit.
4. Performance Bond: Applicant to either (1) post a faithful performance
bond in the amount of $5,000 to ensure landscaping, fencing, and
striping of parking areas within 3 months of completion of construction;
or (2) file a written agreement to complete landscaping, fencing, and
striping of parking areas. Bond or agreement to be filed with the
Planning Depar~ent prior to application for a building permit.
5. Utilities: Applicant to submit a plan to the Planning Department, prior
to installation of PG&E utility (transformer) boxes, indicating the
location of boxes and screening (if boxes are above ground) for approval
of the Planning Director.
6. Equipment Screening: All mechanical equipment on roofs and all utility
meters to be screened as approved by the Planning Direct.or.
7. Occupancy: Building occupancy will not be allowed until public
improvements are installed.

Parking: All parking and driveway areas to be developed in compliance
with Chapter 21.50 of the Campbell Municipal Code. All parking spaces
to be provided with appropriate concrete curbs or bumper guards.
Utilities: Underground utilities to be provided as required by Section
20.36.150 of the Campbell Municipal Code.
Plan Check: Plans submitted to the Building Department for plan check
shall indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television cables,
etc.
Trash Collection: Ordinance No. 782 of the campbell Municipal Code
stipulates that any contract for the collection and disposal of refuse,
garbage, wet garbage and rubbish produced within the limits of the City
of Campbell shall be made with Green Valley Disposal Company. This
requirement applies to all single-family dwellings, multiple apartment
units, to all commercial, business, industrial, manufacturing and
constriction establishments.
Trash Containers: Trash containers of a size and quantity necessary to
serve the development shall be located in areas approved by the Fire
Department. Unless otherwise noted, enclosures shall consist of a
concrete floor surrounded by a solid wall or fence and have self-closing
doors of a size specified by the Fire Department. All enclosures to be
constructed at grade level and have a level area adjacent to the trash
enclosure area to service these containers.
Noise: Noise levels for the interior of residential units shall comply
with minimum State (Title 25) and local standards as indicated in the
Noise Element of the Campbell General Plan.
Property Maintenance: The applicant is hereby notified that the property
is to be maintained free of any combustible trash, debris and weeds, until
the time that actual construction commences. All existing structures
shall be secured by having windows boarded up and doors sealed shut, or
be demolished or removed from the property. Sect. 11.201 & 11.414, 1979

Park Dedication Fees: Pay a fee in lieu of dedicating land for parks for
the two additional units in the amount of $l 1,270 (Two new units at
$5,635/unit).
I9. Tree Clearance: Trees adjacent to driveway approach to be trimmed
trees to provide a I5 foot clearance over the driveway location.
20. Maintenance: Property owners to maintain the on-site parking area
within the public right-of-way.

After due consideration of all evidence presented, the City Councili did
find as follows:
The proposal is significantly less dense than permitted in the
General Plan.
The proposal provides 13 parking spaces for a ratio of 3.25
spaces per unit.
The proposal provides sufficient setbacks from the existing
structures to the east to ensure adequate lights and air.
The building massing has been reduced and rearyard setback
increased to reduce impacts on surrounding development.
Based upon the foregoing findings of fact, the City Council
further finds and concludes that:
The proposed development and uses clearly would result in a more
desirable environment and use of land than would be possible
under any other zoning classification; and
The development and uses would be compatible with the Generali
Plan of the City and will aid in the harmonious development of
the immediate area.
The proposed development will not result in allowing more

Mr. Kurt Anderson for plans, elevations, and development schedule tO
allow the construction of 4 townhomes, in a Planned Development Zoning
District. Copies of Said Exhibits are on file in the Planning

ZC 90-09/PD 90-04 was approved by Council on 10-16-90. Approval
expired 10-16-91 since no construction had begun. A condition of~
approval was the payment of park impact fees of $13,644 (three
new units @ $4,548 each). Applicant has applied for a
reinstatement of the ZC and PD approval and has submitted a new
development schedule.
Tentative map approval was granted by Council on 8-6-91. This
approval is good for two years and will expire on 8-6-93. A
condition of approval was the payment of Quimby fees of $9,096
(two new units @ $4,548 each - it was determined that there were
two existing units currently on the property and that fees should
be collected only for two new units).
RECOMMENDATIONS:
Per the Fire Department's request, a condition should be added
requiring the protection and preservation of the large sycamore
street tress across the properties frontage. The applicant is to
hire a licensed arborist to trim the trees to provide a 15'
clearance over the driveway. Public Works (Vince Huppe) agreed
that City crews would continue to keep this tree trimmed to
provide the 15' clearance.
JUSTIFICATION FOR CONDITIONS OF APPROVAL:
Revise condition #18 - Pay park impact fee of $11,270. (Since
this is a reinstatement, the previous PD expired, the current
park impact fees are being assessed to the reinstatement. These
are two new units @ $5,635 each in R-3 21-27 dwelling units/acre
category).
Dedication of an additional ten feet for street right of way to
widen Apricot to 30' from centerline. This requirement makes
this development consistant with other developments along
Apricot. Although at this time the City has no intention of ever
widening the curb to curb dimension on Apricot, some discussion
regarding a future widing of the planter strip along this street
has taken place.
Add a condition that the property owners are to be responsible
for maintenance of any parking areas within the public right-of-
way. The dedication to 30' from centerline puts a portion of a
parking stall in the public right-of-way. Some discussions
regarding the Planning Director approving a minor modification to
the site plan and eliminating this space took place, but the
issue has not yet been resolved. Maintenance of this area is to
be the property owners responsibility.

PARK FEES:

unresolved.

The Planning Department has completed a review of the plans submitted to
the Building Department for the above referenced project. We are unable to
release the builidng permits at this time. Please be advised that the Planned
Development Permit expired on October 16, 1991. Therefore, it will be
necessary for you to file an application for reinstatement with the Planning
Department. The Tentative Parcel Map is valid until August 6, 1993.
In reference to the outstanding Conditions of Approval, please note the
following:
1) Landscape Plan: Revised landscape plan indicating substantial tree planting
along the rear property line and 32 feet along the western property line
(extending from rear property line) as redlined on the approved plans. The
landscape plan shall be submitted to the Site and Architectural Review
Committee for approval. (Condition #1 PD 90-04)
2) Fence Plan: Fencing plan indicating the design details and location to be
submitted to the Planning Director for approval. The approved plans indicate
