CC Resolution 10871 RESOLUTION NO. 10871 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE A REIMBURSEMENT AGREEMENT FOR SIDEWALK AND PAVING IMPROVEMENTS FOR THE SALMAR SIDEWALK/RESURFACING PROJECT 05-03 IN AN AMOUNT NOT TO EXCEED $150,000. WHEREAS, the adopted FY 2004-2005 Capital Improvement Program includes the Salmar Sidewalk/Resurfacing Project 05-03 for construction of sidewalks; and WHEREAS, the original scope of the project has been reduced as the likelihood of future residential developments on the north and west side of Salmar Avenue are seen as more likely and would, upon redevelopment, be required to install new sidewalks; and WHEREAS, there is no continuous pedestrian access on the east side of Salmar Avenue; and WHEREAS, the Hamilton Salmar Overlay Project (05-07) held off on the east-west portion of Salmar due to the proposed utility installations required for the 430 Salmar Avenue development; and WHEREAS, a reimbursement agreement with the developer of 430 Salmar Avenue could realize savings through economies of scale as the development will be constructing similar improvements; and WHEREAS, a Notice of Improvement Obligation for construction of the sidewalk and driveway approaches would be prepared and recorded upon completion of the project for each of the abutting properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell does hereby authorize the Public Works Director to execute a reimbursement agreement for sidewalk and paving improvements for the Salmar Avenue Sidewalk/Resurfacing Project 05-03 in an amount not to exceed $150,000.
