PC Res 3222RESOLUTION NO. 3222 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SIGN APPLICATION (SA 99-06) TO ALLOW A 100 SQUARE FOOT WALL SIGN FOR MARX LEATHER & HOME OFFICE ON PROPERTY LOCATED AT 150 N. SAN TOMAS AQUINO ROAD IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. MARK DAVIS, ON BEHALF OF MARX LEATHER & HOME OFFICE. FILE NO. SA 99-03. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application SA 99-06: 1. The proposed 100 square foot wall sign is architecturally compatible with existing approved signs at the San Tomas Plaza Shopping Center. 2. The proposed size of the wall sign is proportional to the building. The proposed wall sign will promote the economic viability of the City by providing adequate identification and visibility of the new business, and will also best serve the public welfare and be in keeping with the principles and purposes of the City' s Sign Ordinance. The subject site would best be served by the additional sign area for the wall to promote better visibility of the business, given the lengthy distance of the tenant space to W. Campbell Avenue, which approximately 660 feet. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: o The proposed wall sign is consistent with the General Plan and Zoning designations for the site with approval of a sign exception. The new retail business would not be adequately identified without approval of the additional sign area for the wall sign. The proposed sign will not be detrimental to the public welfare or persons in the neighborhood or the City as a whole. The proposed sign will not unnecessarily detract from the public health, safety and welfare and are not indecent or offensive to the senses. Planning Commission Resolution No. 3222 SA 99-06 - 150 N. San Tomas Aquino Road -Marx Leather & Home Office Pa~e 2 Further, the applicants are notified as part of this application that they are required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this application and are not herein specified. And, that this approval is granted subject to the following Conditions of Approval. Approved Plans: Approval is granted for an exception to the sign ordinance to allow a 100 square foot wall sign on the fascia of the building to be occupied by a new retail furniture store, Marx Leather and Home Office, to be located at 150 N. San Tomas Aquino Road in the San Tomas Plaza Shopping Center. Approval shall substantially comply with the plans as submitted by Allen Signs, except as herein modified by the Planning Commission. 2. Building Division Requirements: Applicant shall comply with all Building Code requirements and obtain necessary permits as determined by the Building Division. Sign Permits Required: The applicant shall obtain a sign permit for all signs installed on the site, in compliance with Campbell Zoning Ordinance, Chapter 21.53. Any temporary signs, including but not limited to, signs for sales and promotional events shall be reviewed and approved by the Community Development Department and a valid Sign Permit obtained before the signs are displayed.
