Subject: Storm Sewer Connection for Proposed Medical Clinic on
Bascom Avenue (County File #14A76.26)
Gentlemen:
At a meeting in this office on February 9, 1978, attended by
representatives of the developer, the Transportation Agency and the
Cities of San Jose and Campbell, I outlined the possible alternatives
that could be recommended to the Board of Supervisors to resolve the
apparent impasse that has developed with respect to a connection from
the Medical Clinic development to the existing storm sewer in Bascom
Avenue within the city limits of the City of San Jose. The Board of
Supervisors referred this matter to this office on February 6, 1978,
when the item appeared on the Board agenda. The Medical Clinic
development project is now in the final stages of county approval
following rezoning of the property and conditional approval by the
County's Architectural and Site Approval Committee.
It is my understanding that the positions of the City of Campbell,
the City of San Jose and Developer are substantially as follows:
City of Campbell's Position
1) The property is in the sphere of influence of Campbell. The
City desires to annex the property but cannot do so at the
present time because it is not contiguous to the city limits.
2) The zoning and proposed use are generally compatible with
city ordinances and standards.

3) The City would approve a connection to the storm sewer if
development occurred under City jurisdiction.
4) The City may recommend that the City of San Jose allow a
direct connection to the storm sewer if certain requirements
(unstated) were met.
City of San Jose's Position
1) The storm sewer in Bascom Avenue was installed as a City of
San Jose project. Both the County and the City of Campbell
participated in the cost of this system. In the county's case,
there was an agreement approved by the Board of Supervisors
which provided for a 60% (city) and 40% (county) division of
costs on the project. Campbell participated in the cost of
another portion of the system.
2) San Jose would approve a connection for development of the
Medical Clinic property if it was in the City limits of
Campbell. It has not approved a connection at this time
because it is the City's policy to discourage development in
unincorporated territory. The city may be willing to modify
its position based on recommendations by the City of Campbell.
3) There are no benefits to the City of San Jose from this storm
sewer connection other than collection of area fees.
Developer's Position
1) Developer is willing to meet city and county design standards
and to pay the City of San Jose's area fee and pro rata share
of costs to the county for connection to the storm sewer.
2) Developer strongly objects to connection to the storm sewer in
Holmes Avenue because of the high costs. An additional
obstacle is the lack of an easement in which to install a pipe
from the Medical Clinic to Holmes Avenue.
3) Developer would not object to annexation to the City of Campbell
if it were possible to do so -- assuming that it would be
allowed to proceed with the development.
4) Developer's property has been rezoned by the county and he is
willing to meet county conditions of approval for development,
except any requirement to connect to the Holmes Avenue storm
sewer.

At the conclusion of the meeting, I agreed to write to the two
cities explaining possible alternatives for resolution of the problem
and urging all parties to reach a mutually acceptable solution. The
alternatives that were discussed are:
1) City of Campbell and Developer reach agreement on annexation
and other issues, if any. Upon reaching agreement, the City
of Campbell would request the City of San Jose to issue an
encroachment permit for a direct connection to the storm
sewer in Bascom Avenue. Payment of the city's area fee (and
the county's pro rata share) would be expected.
2) If solution #1 fails for any reason, the County could allow
Developer to connect to the catch basin in unincorporated
territory which in turn connects to the storm sewer under
the control of the City of San Jose. Since such a connection
would circumvent controls by either city, the matter would be
reported to the Board of Supervisors for a policy decision.
3) The third possible solution is to connect to the storm sewer
in Holmes Avenue avoiding the issue of the Bascom Avenue storm
sewer. This solution is not acceptable to Developer.
4) The fourth and least desirable alternative from a design and
maintenance viewpoint is to fill the land at the rear of the
property and either surface drain all the paved area to the
Bascom Avenue gutter or install a pipe and bubble the drainage
into the street.
This office would be happy to call another meeting or do anything
reasonable to resolve this problem. It does not need to be actively
involved at this time if solution #1 is acceptable to all parties. It
is respectively requested that the two cities and the developer attempt
to reach a mutually satisfactory solution. I will proceed to set up
another meeting if informed by any of the parties that this step is
necessary. In any case, I must report back to the Board of Supervisors
within a reasonable length of time.
