GRANT OF EASEMENT
FOR IRRIGATION DEVICES
This Agreement made this 1st day of August, 1994, by and between Steven S.
Conner. Phillip R. Boyce & Susan E. Boyce, hereinafter referred to as "Grantor", and the
CITY OF CAMPBELL, hereinafter referred to as "Grantee".
RECITALS
WHEREAS, Grantor is the owner of certain real property commonly known as 1701-
1725 South Bascom Avenue, Campbell, Santa Clara County, State of California, hereinafter
referred to as the "Servient Tenement," and described herein below; and
WHEREAS, Grantee desires to acquire an easement appurtenant for the purpose of
installing and maintaining irrigation devices for the benefit of the public; and

WHEREAS, Grantee is the owner of certain public streets within the City of Campbell,
Santa Clara County, State of California including, but not limited to, South Bascom Avenue,
hereinafter referred to as "Dominant Tenement".
NOW, THEREFORE, it is agreed as follows:
GRANT OF EASEMENT
1. Grantor hereby grants to Grantee an easement as hereinafter described.
CHARACTER OF EASEMENT
2. The easement granted herein is appurtenant to the dominant tenement.

DESCRIPTION OF EASEMENT
3. The easement granted herein is a right to install and maintain irrigation devices
and related equipment.
LOCATION
4. The easement granted herein is located on all that property situate in the City of
Campbell, County of Santa Clara, State of California described as follows:
Beginning at a point on the centerline of Bascom A venue formerly known as San Jose-Los Gatos
Road shown as a monument at the intersection of the centerlines of Bascom A venue and Campisi
Way on a certain Record of Survey f1led in the office of the Recorder of the County of Santa
Clara in Book 466 of Maps at Page 5;
Thence North along the monumented centerline of Bascom Avenue a distance of 298.05 feet to
a point;
Thence West a distance of 47.00 feet to the True Point of Beginning, an iron pipe also being
the southeast corner of parcel shown on a certain Parcel Map in the office of the Recorder of
the County of Santa Clara in Book 402 Maps at Page 29;
Thence North a distance of 5.00 feet;
Thence East a distance of 10.00 feet;
Thence South a distance of 5.00 feet;
Thence West a distance of 10.00 feet to the True Point of Beginning:
Containing an area of 50.00 square feet more or less.
EXCLUSIVENESS OF EASEMENT
5. The easement granted herein is exclusive to Grantee subject to any public utility
easements previously granted by Grantor.

SECONDARY EASEMENT
6. In addition to the construction and operation of irrigation equipment and meters,
the easement granted herein includes rights of reconstructing, repairing, and maintaining
irrigation equipment and includes the rights of ingress and egress for such purposes.
REPLACEMENT OF FACILITIES
7. The Grantee agrees to replace in kind, or as mutually agreed upon, landscaping
and irrigation facilities damaged in the course of constructing and maintaining the improvements.
ENTIRE AGREEMENT
8. This instrument contains the entire agreement between the parties relating to the
rights herein granted and the obligations herein assumed. Any oral representations or
modifications concerning this instrument shall be of no force and effect excepting a subsequent
modification in writing, signed by the party to be charged.
AITORNEY'S FEES
9. In the event of any controversy, claim, or dispute relating to this instrument or
the breach thereof, the prevailing party shall be entitled to recover from the losing party
reasonable expenses, attorney's fees, and costs.
BINDING EFFECT
10. This instrument shall bind and insure to the benefit of the respective heirs,
personal representatives, successors, and assigns of the parties hereto.

in the easement area, Grantee shall furnish Grantor with certificates of insurance evidencing
comprehensive general liability insurance, unemployment compensation insurance and such other
insurance as Grantor may reasonably request naming Grantor as an additional insured.
