RESOLUTION NO. 9681
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AWARDING A CONTRACT TO WATTIS CONSTRUCTION COMPANY, INC. FOR
BURROWS/SAN TOMAS AQUINO ROAD RECONSTRUCTION PROJECT #98-02, PHASE II-C,
AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE THE CONTRACT,
AUTHORIZING THE PUBLIC WORKS DIRECTOR AND CITY ENGINEER TO EXECUTE
CONTRACT CHANGE ORDERS, AUTHORIZING THE PUBLIC WORKS DIRECTOR TO
EXECUTE AN AGREEMENT WITH SCVTA FOR BUS STOP IMPROVEMENTS, AND
APPROVING THE A TT ACHED BUDGET ADJUSMENT
WHEREAS, bids were received for the construction of Burrows/San Tomas Aquino Road
Reconstruction Project #98-02, Phase II-C on April 27, 2000; and
WHEREAS, Wattis Construction Company, Inc., has been found to be the lowest responsible
bidder for the total base bid in the amount of $1,163,705.00; and
WHEREAS, San Jose Water Company and West Valley Sanitation District have agreed to
reimburse the City for the costs associated with additive bid items Al and A2 in the estimated amount
of $12,540.00, plus 15 % overhead, for a total of $14,421.00 for work associated with adjusting their
respective utility covers to grade; and
WHEREAS, favorable bids were received and allocating a construction contingency of 20% is
recommended to allow for an increased ability to complete additional on-site conforms or other work
necessary to accommodate the requests of the adjacent property owners whose properties are so closely
interrelated to this project, or other work required to resolve unforeseen issues; and
WHEREAS, the Public Works Director will execute an agreement with VTA for VTA to
reimburse the City for the installation of bus stops on Burrows Road in an amount not to exceed
$18,000; and
WHEREAS, the City Engineer has requested property owners who have Deferred Street
Improvement Agreements to fulfill those agreements by repaying the City for the cost of those
improvements installed within the proposed project, which will add additional project revenue of
$9,070; and
WHEREAS, a budget adjustment has been prepared to increase the total project budget to
reflect the increased revenues available to the project.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby awards the contract for construction of the Burrows/San Tomas Aquino Road Reconstruction
Project #98-02, Phase II-C to Wattis Construction Company, Inc. and authorizes the Public Works
Director to execute a contract with Wattis Construction Company, Inc. in the amount of $1,176,245.00
and encumber a 20% construction contingency in the amount of $235,249.00; and authorizes the Public
Works Director or City Engineer to execute contract change orders up to and within this 20 %
contingency limit.
BE IT FURTHER RESOLVED that the City Council of the City of Cambpell hereby
authorizes the Public Works Director to execute an agreement with the Santa Clara Valley
Transportation Authority for bus stop improvements within the Burrows/San Tomas Aquino Road
Project area.

BE IT FURTHER RESOLVED that the City Council of the City of Campbell hereby approves
the attached budget adjustment in the amount of $41,491.00
