RESOLUTION NO. 9656
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL, DENYING A TENTATIVE PARCEL MAP TO ALLOW
THE CREATION OF TWO RESIDENTIAL LOTS ON PROPERTY
LOCATED AT 299 N. HARRISON AVENUE IN AN R-M-S
(MULTIPLE FAMILY RESIDENTIAL) ZONING DISTRICT.
APPLICATION OF MR. JAMES KENNEDY. FILE NO. PLN2000-10
(PM)
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council did find as follows with
respect to application PLN2000-10 (PM):
1. The lot areas of each of the two lots would be less than the 6,000 square-foot minimum
lot size of one unit on each lot and the 7,000 square-foot minimum for two units on each
lot in an R-M-S zone.
2. The proposed improvements on one of the proposed lots would result in a building
coverage of 41.6%, which is greater than the 40% maximum coverage allowed in an R-
M-S zone.
Based on the foregoing findings of fact, the City Council further finds and concludes that, subject
to the imposed conditions:
1. The proposed map is not consistent with the R-M-S zoning and General Plan.
2. The proposed design and improvements are not consistent with the R-M-S zoning and
General Plan.
