RESOLUTION NO. 9655
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE MA YOR TO EXECUTE AMENDMENT NO.3 TO THE
IMPLEMENTATION AGREEMENT AMONG SANTA CLARA COUNTY TRANSIT
DISTRICT, THE COUNTY OF SANTA CLARA, PARTICIPATING CITIES AND
ELLER MEDIA COMPANY FOR TRANSIT SHELTER ADVERTISING PROGRAM
AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY FUTURE
AMENDMENTS
WHEREAS, on January 6, 1998, the City of Campbell adopted Resolution No.
9318 authorizing the Mayor to execute an Implementation Agreement with the Valley
Transportation Authority for a Transit Shelter Advertising and Maintenance Program;
and
WHEREAS, on March 23, 1998 the Second Amendment to Implementation
Agreement for Transit Shelter Advertising Program was executed by the City of
Campbell thus making Campbell party to the countywide implementation agreement and
thereby subject to its terms; and
WHEREAS, the purpose of Amendment No. 3 is to establish a schedule of
liquidated damages to be assessed in the event the Contractor fails to comply with certain
requirements of the Implementation Agreement;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Campbell that the Mayor is hereby authorized to execute the Third Amendment to the
Implementation Agreement for the Transit Shelter Advertising and Maintenance Program
and that the City Manager is authorized to execute any future amendments to said
agreement.
