State of California, an easement to build and maintain an underground drainage pipeline, and
necessary devices and appurtenances, over, under, along and across, all of that certain real
property within said City and more particularly described as follows:
SEE EXHIBIT A ATTACHED HERETO AND MADE A PART HEREOF
Said property contains 18,927 square feet, more or less, and is generally shown on the attached
Plat Map.
The Grant of Easement herein contained shall include the right to enter said premises, to survey,
construct, reconstruct, lay, relay, maintain, operate, control, use and remove said pipeline, its
fixtures, appurtenances, and to remove objects interfering with the construction, operation and
maintenance thereof. The Grantor reserves the right to occupy and use said premises for any
purpose not inconsistent with the rights and privileges above granted and which will not interfere
with or endanger said pipeline, its fixtures and appurtenances or the use thereof. The City shall
use due care in the construction, operation and maintenance of said pipeline, its fixtures and
appurtenances.
The provisions hereof shall inure to the benefit of and be binding upon heirs, successors, assign,
and personal representatives of the respective parties hereto.

November 14, 1968 in Book 244 of Maps, at page 42, Santa Clara County Records, and being
more particularly described as follows:
BEGINNING at the southwest corner of said parcel of land; thence, along the westerly line of
said parcel of land, and the easterly line of State Highway 17, along a non-tangent curve to the
left, from a tangent bearing of North 14003'46" East, having a radius of2800.00 feet, through a
central angle of20010'40", for an arc distance of986.07 feet to the northwest corner of said

Execution of Quit Claim and Acceptance of Storm Drain Easement - 1875 S.
Bascom Avenue (Resolution/RolI Call Vote)
RECOMMENDATION
That the City Council adopt the attached resolution authorizing the Public Works Director to execute the
Quit Claim Deed for an existing stann drain easement and authorize the City Clerk to accept and record
the new stann drain easement on property located at 1875 S. Bascom Avenue (The Pruneyard).
DISCUSSION
On January 20, 1998, the City Council adopted Ordinance 1955 approving a Special Development Pennit
(SOP 97-01) and Site and Architectural Approval (S 97-20) to allow the construction of an office building
and parking garage on property located at 1875 S. Bascom, The Pruneyard.
Conditions of approval for the development included the requirement to modify an existing stann drain
easement to accommodate the construction of the proposed new parking structure. The attached documents
relinquish the existing stonn drain easement, and create a new, modified easement as required by the
conditions of approval. This modification will not impact the City's ability to utilize this easement for
future stonn drain construction.
FISCAL IMPACT
There is no fiscal impact associated with this action.

Do not authorize the Public Works Director and City Clerk to execute the documents. This is not
recommended because the stonn drain easement is needed, but must be modified to reflect the parking
structure location as indicated in the conditions of approval for the development.

This moming, you and I spoke about the city approval to proceed with the PG&E gas hook-up. You indicated
that you would like for us to provide more infonnation in regards to project completion. Webcor expects to
complete the building on the week of March 2200, 1999. CWTently our schedule dictates the following dates
of completion:
Elevators (State Approval) - 3/17/99
All perimeter sidewalks into the building - 3/10/99
I'vIain Lobby of the building (with the exception of some wood finishes and specialty lighting) - 3/16/99
Our mechanical subcontractor has indicated the testing and balancing of our HVAC system will take six
weeks to complete from the date gas has been provided. As you can tell, our schedule could be severely
impacted by any delays to the gas hook-up.
Drawing P3.2 of our approved set shows the gas riser for our building. As indicated in the drawing, the gas
line provided will only service the boiler in the penthouse. Nothing else in the building will be serviced by
this line. Therefore, I believe the security of this gas line is well maintained due to the absence of any branch
lines throughout the building.
I hope this letter provides the infonnation you need to comfortably release PG&E to provide meter hook-up
and gas service to the building. Please contact me if you have any further questions.

Being a portion of a twenty foot wide storm drain easement granted to the City of Campbell,
filed October 25, 1996, recorded in Book 4509, Page 180, Official Records of Santa Clara,
situate in the City of Campbell , County of Santa Clara, State of California, being more
particularly described as follows:
COMMENCING at a point on the Easterly right-of-way of State Highway 17 and the
Northwesterly comer of the certain parcel of land as shown on that Record of Survey recorded
November 14, 1968 in Book 244 of Maps, at Page 42, Santa Clara County Records~ thence along
the Northerly line of said parcel South 89052'04'OT East, 20.12 feet to the Easterly line of said
twenty foot storm drain easement~ thence, along said Easterly line from a tangent bearing of
South 06004'20" East, along a curve to the right, having a radius of2,820.00, through a central
angle of 02040' 18", an arc length of 131.50 feet to the TRUE POINT OF BEGINNING~
thence from a tangent bearing of South 03024'02" East, along a curve to the right, having a
radius of2,820.00 feet, through a central angle of 03043'31", an arc length of 183.35 feet;
thence, leaving said Easterly line and across said storm drain easement, West, 4.59 feet~ thence,
North 27.78 feet~ thence, from a tangent bearing of North 00014'24" West, along a curve to the
left, having a radius 2815.39 feet, through a central angle of 020 13'06", an arc length of 109.00
feet~ thence, North 46.51 feet~ thence, East, 2.24 feet to the TRUE POINT OF BEGINNING.

FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
PRUNEYARD ASSOCIATES, LLC
a California limited liability company
hereby GRANT(s) to the City of Campbell, a municipal corporation, of the County of Santa Clara, State of
California, an easement to build and maintain an underground pipeline, and necessary devices and appurtenances,
over, under, along and across, all of that certain real property within said City and more paniculariy described as
follows:

Said property contains 0.453 acres, more or less, and is generally shown on the attached Plat Map.

The Grant of Easement herein contained shall include the right to enter said premises, to survey, construct,
reconstruct, lay, relay, maintain, operate, cona-ol, use and remove said pipeline, its fIxtures, appunenances, and
to remove objects interfering with the construction, operation and maintenance thereof. The Grantor reserves
the right to occupy and use said premises for any purpose not inconsistent with the rights and privileges above
granted and which will not interfere with or endanger said pipeline, its fIXtUres and appurtenances or the use
thereof. The City shall use due care in the construction, operation and maintenance of said pipeline, its fixtures
and appunenances.
The provisions hereof shall inure to the benefIt of and be binding upon heirs, successors, assigns, and personal
representatives of the respective parties hereto.
