A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
APPROVING THE FINAL TRACT MAP FOR TRACT NO. 9465,
ACCEPTING THE PUBLIC STREET RIGHTS-OF-WAY AND
PUBLIC EASEMENTS OFFERED THEREON, AND
SUMMARILY VACATING EXCESS PUBLIC STREET RIGHT-OF-WAY
FOR PROPERTY LOCATED AT 1255-1461 HACIENDA AVENUE
WHEREAS, on November 19, 2002, the City Council of the City of Campbell
adopted Resolution No. 10117 approving a Tentative Subdivision Map for property
located at 1255-1461 Hacienda Avenue; and,
WHEREAS, the Final Tract Map has been submitted and found to be in
compliance with the Subdivision Map Act and Title 20 of the Campbell Municipal Code;
and,
WHEREAS, public street rights-of-way and public easements are shown on the
map and offered for dedication; and,
WHEREAS, property on the north side of Hacienda Avenue is no longer
necessary for public street purposes; and,
WHEREAS, the vacation is to be made pursuant to Chapter 4, Summary
Vacation, of Part 3 of Division 9 of the California Streets and Highways Code; and,
WHEREAS, a legal description and plat depicting the excess public street right-
of-way to be vacated and the public service easement to be reserved are correctly
described in Exhibit "A" attached.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell hereby approves the Final Tract Map for Tract No. 9465, consents to the
recording of said map, and accepts the public street rights-of-way and public easements
offered for dedication on said map in accordance with the terms of the offer; and,
BE IT FURTHER RESOLVED that the City Council of the City of Campbell
hereby vacates excess public street right-of-way on the north side of Hacienda Avenue
west of San Tomas Aquino Road as described in Exhibit "A" attached, reserving a public
service easement as described in said Exhibit "A"; and,
BE IT FURTHER RESOLVED that the City Council of the City of Campbell
hereby authorizes the Public Works Director to sign documents necessary to effect the
transfer of ownership of said vacated public street right-of-way to the owners of 1255-
1461 Hacienda Avenue.

All that certain real property situate in the City of Campbell, County of Santa Clara,
State of California, described as follows:
BEGINNING at the point of intersection of a Northwesterly comer of that certain parcel
of land conveyed to the City of Campbell, a Municipal Corporation of the County of
Santa Clara, State of California, by deed recorded March 18, 1966 in Book 7317 of
Official Records at page 113, Santa Clara County Records, with the Southeasterly line of
Lot 4 of Tract No. 479, a map of which was filed for record in Book 18 of Maps at page
29, Santa Clara County Records; thence from said POINT OF BEGINNING along the
Northerly line of said parcel conveyed to the City of Campbell N83°00'50"E 798.66 feet;
thence leaving said Northerly line from a tangent bearing of S83°00'50"W along a curve
to the left with a radius of 200.00 feet through a central angle of 9°29'14'' for an arc
length of 33.12 feet; S73°31'36"W 39.61 feet; along a tangent curve to the right with a
radius of 200.00 feet through a central angle of 9°29'14'' for an arc length of 33.12 feet to
a point in a line parallel with and distant 12.00 feet Southerly from the northerly line of
said parcel conveyed to the City of Campbell; thence along said parallel line
S83°00'50"W 696.96 feet to a point in said Southeasterly line of Lot 4; thence leaving
said parallel line along said Southeasterly line N08°23'06"E 12.45 feet to the POINT OF
BEGINNING excepting therefrom a public service easement.
