The Map Act provides that after four years the City could initiate proceedings to revert the land back to acreage if we so choose. Of course we prefer not to have such a long period of time elapse because of unanti- cipated changes in the Cityls policy that could affect the subdivision. In this case the City has enacted a Condominium Ordinance that may yet have an adverse ef- fect on this project. The subdivider currently has Planning approval to construct the units he proposed. But that approval will expire in June of this year. If the applicant has to go back before the Planning Commission for another time extension, he could conceivably have a problem. The new ordinance might dictate a lower density than is now approved. We would not want to be put in the position of having to deal with the question of how to lower the density in a project when a final map had been previously approved at the higher density. The map that created the lots is not a problem. Obtaining site approval to build on those lots could become a probem if the current approval is allowed to lapse again. The solution that was finally agreed to by you and the City involved a private line in an easement to the Garrison property north of you. It turns out that the contractor who did the work for you terminated the 1 ine at the manhole on your property, rather than extending it to your southerly property as was required by the permit we issued at the time. Rather than require you to extend the line at this late date, we prefer to lay such an obligation on the developer of the property to the south of you. In order to be able to do this, we need you to execute the enclosed storm drain easement. The easement will only extend from your southerly property I ine to the manhole, approximately 21 feet. Dear Sam: As you may recall, I notified you on March 7, 1980 that our topographic survey indicated that the 12" storm drain into which we ore to connect terminates 20 feet Northerly of your property in the existing paved driveway of the Rosen property. Also, on said date, you authorized me to find out if Rosen could be forced to extend the storm drain Southerly to your property line. On March 10, 1980, I met with Dave Valkenoar, City of Campbell, Design Engineer, to determine the facts of the situafion. It was determined that the original excavation permit (under which the drain was installed) did require that the drain be extended Southerly to your property line. However, since the driveway pavement had been installed prior to the discovery by the City that the drain hadn't been stubbed out to your property I ine, the City revised the conditions and accepted the drain as installed, on the basis thct an ease- ment would be provided to allow you to cross the Rosen property to connect to the end of the storm drain. The City approved the project as complete in Oecember, 1979. On March 25,1980, I met with Joe Elliott (Director of Public Works),~ Helms (.Assistant Director of Public Works) and Dave Valkenaar, at the Campbell City-Hall to determine if Rosen could be forced to comply with the requirements of the original excavation permit. The City stated that since they set the conditions of the excavation permit they can also revise the conditions as may be necessary. In th is case, they arbitrari Iy decided that Rosen had done enough construction since he had to extend the drain Northerly of his property to connect to the drain where terminated by others. (It is to be noted that the area drain fees allow some credit for offsite construction). Pag e 2 Further, the City stated that you are getting a good deal in only having to extend the storm drain 20 feet offsite to connect to the existing storm drain (even though it will be through existing pavement). They will qet an eC5ement to cover the construction when you need it. ~ In summary, it doesn't appear to me, under the circumstances, that there is anything else to do but to install the drain through the driveway at your own expense ($500 more or less).
