RECOMMENDED ACTION:
Approve the tract map and accept documents as noted on the
attached checklist.
There are no County costs involved in this Board action (all
roads/driveways are to be privately maintained).
REASONS FOR RECOMMENDATION:
All conditions of approval established by the Board of Super-
visors and the Planning Commission applicable at this time have
been completed.
BACKGROUND :
This is a one-lot tract map for a fourteen unit condominium
located on the westerly side of South Bascom Avenue at Woodard Road.
The property is zoned R3-1.5 (low density multiple dwellings) and
lies within the Urban Service Area of the City of Campbell. However,
certain urban services are being provided by the City of San Jose
(storm sewers) for which necessary permits will be issued. The
Cities of San Jose and Campbell have reviewed the project.
The condominium project was originally approved by the Architec-
tural and Site Approval Committee on September 25, 1980. The one-lot
tract map was approved by the Board of Supervisors on January 5, 1981
(with the understanding that a deferred annexation agreement to the
City of Campbell be executed by the applicant and the existing
structure on the property be relocated).
The work required consists of positive storm water disposal
system that will connect to the City of San Jose storm drain in
Bascom Avenue and frontage improvements (installation of sidewalk).
In addition, extension of a traffic control island within the City
of San Jose South Bascom Avenue right of way is also required and an
encroachment permit from the City is required.
Performance and labor and Materialmen's Bonds have been posted
to guarantee completion of the work.

CONSEQUENCES OF NEGATIVE ACTION:
The Project would not proceed on the basis of the present plans.
STEPS FOLLOWING APPROVAL:
1. The Board of Supervisors authorizes the Chairman to execute the
land development documents. The Clerk of the Board mails copies
of the agreement to:
Dolphin Development, Inc.

2. The Clerk of the Board signs the certificate on the final map
and returns it to the County Surveyor's Office for delivery to
the Recorder's Office.
3. The improvements are completed by the developer within one year
and inspected by the County. Bonds are released by the Board of
Supervisors after final inspection and approval.

WHEREAS, on January 5, 1981, a recomnendation of the Santa
Clara County Planning Commission vas forwarded to the Board of
Supervisors to approve a one lot tentative map for a fourteen unit
condominium on property of DOLPHIN DEVELOPMENT, INC.. (Gerald J.
Bibler), located on South Bascom at Woodard Road: and
WHEREAS, all maps, records, papers and files constituting the
record before the Planning Commission were forwarded to the Board
of Supervisors by the secretary of the Planning Commission; and
WHEREAS, at the time of the public hearing the applicant
agreed to enter into a deferred annexation agreement; and
WHEREAS, this Board does hereby make the following findings:
1. The subdivision i. compatible vith the County General
Plan and applicable &oning district.
2. None of the findings set forth in Santa Clara County
Ordinance Code Section C12-l22 are applicable to the subdivision.
NOW, 'l'HER E FORE , BE IT RESOLVED by the Board of Supervisors

and photDgraphs. The property is adjacent to the City of San Jose but is in the urban
service area Df Campbell. The City of Ca"pbell indicated that the project conforms
to the land Use Element of the Campbell General Plan. No response has been received
from the City Df San Jose. Commissioner Alexander said the developer has worked it
out so the existing ur.it on the property ~L!.Lnot _b~_demolished. The public hearing
was opene~ The applicant's Clrchitect appeared to be heard. They have reviewed
stoff comments and conditions and agr~e and occept':the' conditions. . The city Df Campbell
requested addi tional parking but the applicant feels the requirements of that ci ty are
excessive. The units are 2 bedroom units with a current market price of approximately
$120,000. 'There was no one present to give further testimony and the public hearing
was closed. It was moved by Commissioner Alexande~, seconded by Commissioner Hinoki,
and carried to accept staff's recommendation and adopt a negative declaration on the

A l4-unit apartment complex is proposed to be located on a 33,037 square foat site
in the Campbell urban service area. The site is located on the ....:oesterly sic:~ of
Bascom Avenue, opposite Woodard Avenue. The applicant proposes to build th~e~
t\'/O-StOry apartment complexes. Building 'WI ~-Jill be located 0>1 t;,::: fron!: h~1;= of
the lot and contain four units. Building "B" will be located alc~9 the sOl.tth~:-ly
boundary and contain six units. Building "CI1 v/ill be located on the rear half or
the lot and contain four units. Parking is provided along the northern boundary.
The existing R3-l.5 (Jow-density multiple) zoning would al low approxinately 13
units at a density of 24.2 d\-Jelling units per acre. The propeity ..:dS rezo{;l:::c to
R3-1.5 by the Board of Supervisors in November 1978. Actual building cover~se
will include approximately 32 percent of the total lot area. The Co,mty zoning_
ordinance limits building coverage to 30 percent of the lot area. The appl icant
has applied for a variance to al10\-J an increase in building coverage and also to
reduce the front yard setback from twenty-five feet to eighteen f~et. Do~estic

Connection to the South Bascom Avenue Storm Sewer
Dear Sirs:
Staff members of the City of Campbell, County of Santa Clara and the
City of San Jose met on February 18, 1981 to discuss the proposed
connection of this development to the Bascom Avenue storm sewer.
After some discussion it was agreed that subject development should
be allowed to connect as proposed on the plan for Tract No. 7043 as
submitted by Riley and Associates. The lateral from the site is to
connect to the back of the catch basin which is located on Bascom
about 75 feet southwesterly of the intersection with Woodard Road.
As there has been much controversy during the last two or three
years concerning the service boundary for the Bascom system, the
City of San Jose prefers the completion of a study which would
determine a service boundary agreeable to the three jurisdictions
involved before official approval would be granted for subject
connection. This study is taking much longer than anticipated
since the City of Campbell is performing extensive field survey
work which is necessary for the study to proceed.

allow Campbell and San Jose to master plan the immediate area in
such a way as to minimize the flows to the Bascom line.

study, and since the development is definitely within the service area,
permission to connect to the Bascom system is granted with the follow-
ing condi tions :
1. Payment of storm drain connection fees to the City of
San Jose.
0.759 acres @ $1,815/acre for a total of $1,378
2. The installation of a flap gate or back flow preventor
on-site to minimize the possibility of storm water
backing up into the site as much of the development is
lower than the elevation of the grate of the catch basin.
It is hoped that the boundary study will be completed soon so that
future connection requests can be processed in a more expeditious
manner.
