RESOLUTION NO. 9645
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL GRANTING A PARTIAL WAIVER OF PARK IMPACT FEES
CONSISTENT WITH WAIVER PROVISIONS PROVIDED IN SECTION
13.08.120 IN CONJUNCTION WITH A DEVELOPMENT ON PROPERTY
LOCATED AT 125 E. CAMPBELL AVENUE IN THE C-3-S (CENTRAL
BUSINESS DISTRICT) ZONING DISTRICT. APPLICATION OF MR.
ABBAS HAGHSHENAS.
After notification and consideration, as specified by law, and after presentation by the Community
Development Director, proponents and opponents, the City Council concluded the hearing of this
request.
After due consideration of all evidence presented, the City Council did find as follows with respect to
this request:
1. The applicant's park fee waiver request for the 3 below market rate units is consistent with
advancing the provisions of affordable housing identified in the Housing Element of the
General Plan.
2. Granting of the waiver does not significantly impair the city's ability meet the goals
identified in the Open Space Element of the General Plan.
3. The proposed project provides for the open space needs of the community by contributing
to the Park in-lieu of fee fund for the remaining 17 apartment units.
Based on the foregoing findings of fact, the City Council further finds and concludes that:
1. The proposed project will aid in redevelopment of the Downtown area consistent with the
General Plan and the Redevelopment Plan and
2. The granting of a park fee waiver for the affordable units furthers the goals of the General
Plan and the Redevelopment Plan consistent with the provisions of section 13.08.120
Campbell Municipal Code of the Park Impact Fee Ordinance.
