RESOLUTION NO. 9629
BEING A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF
CAMPBELL DENYING AN APPEAL FOR A FENCE EXCEPTION FOR
PROPERTY LOCATED 235 CHERRY LANE IN AN R-I-6 (SINGLE
FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MS.
LISA ANDERSON. FILE NO. E 99-01.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council did find as follows with
respect to application E 99-01:
1. The proposed fence exception consists of a six-foot high wooden fence with a two-foot high
wooden latticework extension that will bring the total fence height to eight (8) feet above the
existing grade of the subject property.
2. The proposed fence height extension is not consistent with the existing fences surrounding
the subject property and is detrimental to the visual transition between the subject fence with
height extension and existing fences on adjacent properties.
3. The proposed fence height extension does not enhance the aesthetic appearance of the subject
property and the adjacent properties.
4. The proposed fence height extension will not guarantee the privacy of the subject property
from adjacent properties.
5. The proposed fence height extension will create an undesirable impact of additional shade
within the side yard setback of the adjacent townhouse units to the north of the subject site.
Based upon the foregoing findings of fact, the City Council further finds and concludes that:
I. The requested fence exception does not impair pedestrian or vehicular safety.
2. The requested fence exception does not result in a more desirable layout of the applicant's
property and the surrounding properties.
3. The requested fence exception will be detrimental to the health, safety, peace, morals,
comfort or general welfare of persons residing or working in the neighborhood of such
proposed use, or will be detrimental or injurious to property and improvements in the
neighborhood or to the general welfare of the City.
