RESOLUTION NO. 9628
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL APPROVING A MODIF'ICA TION (M 98-16) TO A
PREVIOUSLY -APPROVED PLANNED DEVELOPMENT PERMIT TO
ALLOW THE INSTALLATION OF A FACTORY MANUFACTURED
HOUSE AND CARPORT, FOR USE AS A RESIDENCE FOR THE
PASTOR, ON PROPERTY LOCATED AT 202 RAILWAY AVENUE
IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. FILE
NO. M 98-16.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council finds as follows with respect
to application M 98-16.
I. The installation of the manufactured housing unit as a residence for the pastor is incidental to
the operation of the site as a church facility.
2. The proposed project is consistent with the South of Campbell Avenue Area (SOCA) Plan by
siting the proposed dwelling on the Dillon A venue frontage and using the SOCA guidelines
for residential development to integrate the project with adjacent residential uses.
3. The proposed project is well designed and is architecturally compatible with the surrounding
neighborhood.
4. The proposed project is consistent with other developments in the surrounding area and is
consistent with the development standards for residential uses.
5. Adequate parking is provided for both the church facility and the pastor's residence.
Based upon the foregoing findings of fact, the City Council further finds and concludes that:
1. The proposed development and uses are compatible with the General Plan of the City and
will aid in the harmonious development of the immediate area.
2. The proposed development is consistent with the City's Zoning Ordinance.
3. The proposed development and uses clearly will result in a more desirable environment and
use of land than would be possible under any other zoning classification.

4. The proposed development will not result in allowing more residential units than would be
allowed by other residential zoning districts which are consistent with the general plan
designation of the property.
5. The proposed development will not be detrimental to the health, safety or welfare of the
neighborhood or of the City as a whole.
Further, the applicant is notified as part of this application that they are required to comply with
all applicable Codes and Ordinances of the City of Campbell and the State of California, which
pertain to this application and are not herein specified. And, that this approval is granted subject
to the following Conditions of Approval.
COMMUNITY DEVELOPMENT DEPARTMENT
1. Approved Proiect: Approval is granted for a Modification (M 98-16) to a previously
approved Planned Development Permit (PD 80-06) to install a manufactured housing unit to
be located at 202 Railway. Project approval shall substantially comply with the project plans
prepared by Butch Cotton and Richard Haro, date stamped as received by the Planning
Department on November 12, 1999, except as modified by the Conditions of Approval
herein.
2. Use of Residence: The residence shall be used for occupancy by an employee of the church
and shall not be rented out.
3. Landscaping Plan: The applicant shall submit a landscaping and irrigation plan to be
reviewed and approved by the Community Development Director, prior to issuance of
building permits for the project. The plans shall address the following:
a. Preparation of landscape plans consistent with the City's Water Efficient Landscape
Guidelines (WELS).
b. Provision of street trees and trees in the front yard area with a minimum container size of
15 gallons.
c. Provide shrubs at the base of the unit to screen the foundation.
d. Indicate the installation of an automatic irrigation system.
4. Compliance with previously-approved Planned Development Permit: The applicant shall be
required to comply with all conditions of approval of the previously-approved Planned
Development Permit (PD 80-06), unless superceded or modified by the Conditions of
Approval herein for M 98-16.
5. Park Impact Fee: The applicant shall be required to pay a Park Impact Fee of $10,990 per
unit, prior to issuance of a certificate of building occupancy for each unit.

6. Fences: Any newly proposed fencing shall comply with Section 21.59.090 of the Campbell
Municipal Code. An open slat picket fence shall be installed at the front property line.
7. Architectural Details: Plans submitted for building permits shall include the following
details:
· A minimum roof eave of 8-inches shall be provided.
· The front porch shall have a screen at the base to match the porch materials.
· Trim materials shall be consistent with the samples submitted to the Planning Division on
November 1, 1999.
8. Parking and Drivewavs: All parking and driveways shall be developed in compliance with
the standards in Chapter 21.50 of the Campbell Municipal Code.
BUILDING DIVISION
9. Conditions of Approval: Plans submitted for Building Permits shall include a sheet that
contains a copy of the Conditions of Approval.
10. Plans Required: A building permit application shall be required for the proposed structure.
The permit shall include Electrical, Plumbing, and Mechanical fees when such work is
part of the permi t.
11. Size of Plans: The maximum size of construction plans submitted for building permits
shall be 24-inches by 36-inches. The minimum size is 18-inches by 24-inches.
12. Title 24 Energv Compliance: California Title 24 Energy compliance forms CF-lR and
MF-IR shall be blue-lined on the construction plans.
13. Approvals Required: The project requires the following agency approval prior to issuance
of the building permit.
· West Valley Sanitation District
. Santa Clara County Fire Department
· School Districts
. Campbell Union School District
. Moreland School District
. Cambrian School District
14. Calculations and Details: Provide calculations and details required for review and approval
by the Building Division, prior to issuance of building permits.

15. Limits of Review: Review of this development proposal is limited to acceptability of site

access and water supply as they pertain to fire department operations, and shall not be
construed as a substitute for formal plan review to determine compliance with adopted
model codes. Prior to performing any work the applicant shall make application to the
Building Division for approval of all applicable construction permits.
16. Addressing: Provide minimum 4" address numbers visible to the public right of way.
17. Required Fire Flow: Required fire flow for this project is 1,000 GPM at 20-psi residual
pressure. The required fire flow is available form area water mains and fire hydrant(s),
which are spaced at the required spacing.
PUBLIC WORKS DEPARTMENT
18. Street Improvements: Prior to issuance of any grading or building permits for the site, the
applicant shall execute a street improvement agreement and shall cause plans for public
Street Improvements to be prepared by a registered civil engineer pay fees, post security and
provide insurance necessary to obtain an encroachment permit for construction of the public
improvements, as required by the City Engineer. The plans shall include the following:
· Removal of the existing driveway approach and construction of replacement sidewalk,
curb and gutter and landscape.
19. Maintenance Security: Prior to issuance of occupancy approval for the site, all public street
improvements required by the street improvement agreement and the encroachment permit
must be completed and accepted by the City and the applicant must provide a one-year
Maintenance Security in an amount of 25% of the Faithful Performance Bond.
