PC Res 3161RESOLUTION NO. 3161 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUSLY-APPROVED SITE APPROVAL TO ALLOW A SECOND FLOOR MEZZANINE WITHIN A BUILDING ON PROPERTY LOCATED AT 335 McGLINCEY LANE IN AN M- 1-S (LIGHT INDUSTRIAL) ZONING DISTRICT. APPLICATION OF MR. JAMES BALDWIN. FILE NO. M 98-01 (S 76-30). After notification and public heating, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to application M 98-01 (S 76-30). 1. The existing use is consistent with the General Plan and Zoning designations which indicate industrial land use for this property. 2. The existing second floor totaling 5,727 square feet was constructed within the existing building without issuance of building permits or approvals. The proposed modification to a previously approved site and architectural approval will legalize the existing improvements and bring the property into conformance with current zoning standards. 4. A condition of approval will require additional landscaping to meet the required 8% on-site landscaping for properties zoned Light Industrial. 5. The proposed bathrooms would add approximately 100 square feet to the building. 6. A minor reduction in the required parking of two parking spaces should not adversely impact the existing parking facilities. Based on the foregoing findings of fact, the Planning Commission further finds and concludes that: 1. The proposed project is consistent with the General Plan and zoning. 2. The proposed project will aid in the harmonious development of the immediate area. Planning Commission Resolution No. 3161 M 98-01 (S 76-30) - 335 McGlincey Lane Page 2 3. The proposed site is adequate in size and shape to accommodate the proposed use and site improvements to allow outdoor seating. The proposed project will aid in the enhancement and the harmonious development of the immediate area. The establishment, maintenance, or operation of the use will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, subject to the conditions of approval. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. APPROVED PROJECT Modification to Site and Architectural Approval (S 76-30). The approved Modification recognizes 5,727 square feet that was previously constructed on a second floor (prior to the M 98-04) within an existing building located at 335 McGlincey Lane. The improvements shall become legal after obtaining building permits and final clearance from the City Building Official for the previously constructed improvements. Building Permits. The applicant shall obtain all necessary Building or Electrical permits for all completed construction. All construction must meet all current building codes adopted by the City. o Landscaping Plan: The applicant shall submit a landscaping and irrigation plan to be reviewed and approved by the Community Development Director prior to issuance of building permits for existing and future construction. The plans shall address the following: a. The plans shall be consistent with the City's Water Efficient Landscape Guidelines (WELS). b. Planting shall include tree wells at intervals of 40 feet (maximum) along the side property lines adjacent to the parking spaces. Tree sizes shall incorporate a combination of 24 inch box and 15 gallon trees. c. One tree (15 gallon) shall be planted along the frontage of the property. Planning Commission Resolution No. 3161 M 98-01 (S 76-30) - 335 McGlincey Lane Page 3 o Additional Bathrooms: Approval is granted for two new bathrooms as indicated on the approved plans for M 98-01 subject to the approval of building permits. Street Improvements: Prior to issuance of any grading, drainage or building permits for the site, the applicant shall cause plans for public Street Improvements to be prepared by a registered civil engineer, pay fees, execute a street improvement agreement, post security and provide insurance necessary to obtain an encroachment permit for construction of the improvements, as required by the City Engineer. The plans shall include the following: · Installation of all existing and proposed water meters and sewer cleanouts on private property behind the public right-of-way line. · Installation of 5' attached marginal sidewalk. · Installation of one street light. · Installation of street trees including irrigation system. Utilities: All new on-site Utilities shall be installed underground per Section 20.36.150 of the Campbell Municipal Code for any new or remodeled buildings or additions. Applicant shall comply with all plan submittals, permitting, and fee requirements of the serving utility company. Maintenance Security: Prior to issuance of occupancy approval for the site, all public street improvements required by the encroachment permit must be completed and accepted by the City and the applicant must provide a one-year Maintenance Security in an amount of 25% of the Faithful Performance Bond. Drainage System: Prior to occupancy, the applicant shall refurbish, remodel, and reconstruct the on-site Drainage System, as necessary, to demonstrate that the facilities are functioning normally in accordance with current requirements of the City. Storm Drain Area Fee: Prior to issuance of any grading, drainage, or building permits for the site, the applicant shall pay the required Storm Drain Area fee. The current fee is $2,500.00 per acre or $2,262.00. 10. Storm Water Management: Comply with California Storm Water Best Management Practices Handbook, prepared by Storm Water Quality Task Force, Santa Clara Valley Water District. Planning Commission Resolution No. 3161 M 98-01 (S 76-30) - 335 McGlincey Lane Page 4 11. Flood Control: The applicant shall comply with any requirements of the Santa Clara Valley Water District. 12. Parking Lot Restriping: Applicant shall submit a revised parking layout for review and approval by the Community Development Director prior to the issuance of building permits. The restriped parking plan shall provide a total of 53 parking spaces. Compact parking spaces shall not exceed 40% of all parking spaces. All parking spaces shall conform to Section 21.50 Parking and Loading of the Zoning Ordinance. 13. Fire Department Requirements: Modify the existing fire sprinkler within the building to accommodate the design. A State of California Licensed fire protection contractor shall submit plans, calculations, a permit application and appropriate fees for review and approval prior to commencing any work. Should the work already be completed, schedule a site inspection to verify any completed fire sprinkler modifications.
