BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL APPROVING A CONDITIONAL USE PERMIT TO
ALLOW FOR AN OUT-PATIENT MEDICAL CLINIC (KAISER
FOUNDATION HEALTH PLAN) ON PROPERTY LOCATED 220 E.
HACIENDA AVENUE IN A C-M-S (CONTROLLED
MANUFACTURING) ZONING DISTRICT. APPLICATION OF MS. LEE
ANN KNIGHT, ON BEHALF OF KAISER FOUNDATION HEALTH
PLAN, INC. FILE NO. LIP 98-02.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application UP 98-02:
The provision of a clinic for a major health maintenance organization in a location central to
Campbell and on a public transportation line, is desirable to the public convenience and
welfare of the citizens and workers of Campbell.
2. The proposed use is at the intersection of two arterial streets, which have adequate capacity
for the proposed use.
3. The 160 proposed parking spaces exceeds the 132 space requirement of the City's Zoning
Ordinance for the 22 medical practitioners to be working in the facility.
4. The project is conditioned to require repair of the building, parking, landscaping and trash
facility to meet City property maintenance standards.
5. The proposed hours of operation and deliveries are daytime and early evening hours.
6. The use does not emit dust, fumes, glare, heat, liquids, noise, odor, smoke, steam, vibration
or other such items which create nuisances for the surrounding uses.
7. Hazardous and bio-hazardous materials will be properly stored and removed in conformance
with legal and health requirements.
Based upon the foregoing findings of fact, the Planing Commission further finds and concludes
that:
1. The proposed project is consistent with the General Plan.

The use will not be disruptive to the purpose of the C-M zone to provide an environment
conducive to the development and protection of modem, large-scale specialized
manufacturing, packaging and distribution, research and development, and administrative
facilities which are clean, quiet, and which do not emit dust, fumes, glare, heat, liquids,
noise, odor, smoke, steam, vibration or other such disturbances.

The establishment, maintenance, or operation of the use applied for will not be detrimental
to the health, safety, peace, morals, comfort or general welfare of persons residing or
working ion the neighborhood of the use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the city.
The proposed site is adequate in size and shape to accommodate the yards, walls, fences,
parking and loading facilities, landscaping and other development features required in order
to integrate said is with uses in the surrounding area.
5. The proposed site is adequately served by streets of sufficient capacity to carry the kind and
quantity of traffic such use would generate.
6. The proposed use is compatible with other uses in the area.
The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions in accordance with the ordinance of the City of Campbell and the State of
California. The lead department with which the applicant will work is identified on each
condition where necessary. Additionally, the applicant is hereby notified that he/she is required
to comply with all applicable Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified:
PLANNING DIVISION
1. Approved Proiect: Approval is granted for a Use Permit allowing for the operation of an
out-patient medical clinic with approximately 80 employees, including 22 practitioners,
devoted to providing adult primary care (internal medicine), pediatrics, obstetrics and
gynecology, and treatment of minor injuries on property located at 220-D Hacienda
Avenue. Project approval shall substantially comply with project plans prepared by South
Bay Construction & Development dated July 10, 1981 (site plan), by Anshen + Allen,
Architects, dated received April 2, 1998 (floor use plan), and letter of description on
Kaiser Foundation Health Plan, Inc. letterhead, dated April 2, 1998, except as modified
herein in the Conditions of Approval.

Property Maintenance: The following property maintenance items shall be completed
prior to commencing medical services operations by Kaiser Foundation Health Plan, Inc.:
a. All landscape irrigation facilities within 100 feet of the building shall be checked and
repaired to provide adequate operation and delivery of water to all landscape areas.
b. All landscape areas which have become barren shall be provided with additional top
soil and new groundcover planting.
c. Building D shall be prepped and painted to repair all chipped and peeling paint, rust
and discoloration.
d. The broken curb, located on the west side of the courtyard between Buildings C and
D shall be repaired.
e. The broken slats in the fencing surrounding the trash area to the west of the building
shall be repaired, and the discarded tires removed.
3. Sign Permits: The applicant shall obtain sign permits for all signs.
BUILDING DIVISION
4. Building Permits: All improvements and changes shall be submitted to the Building
Division for review, and any permits deemed necessary by the Building Official or the
Uniform Building Code shall be obtained.
The Building and Use most closely resemble a B Occupancy:
a. Two stories are permitted.
b. The sprinkler system is adequate for the 20,000 square feet of each floor.
c. Any occupancy separation between the "B" and any "I-1.2" health care occupancy
requires a 2-hour separation; the "B" and any "H-3" hazardous materials areas require
a one hour separation.
6. Title 24 requirements shall be met both within the building and within the parking lot.
FIRE DEPARTMENT
7. Applicant shall provide verification of a
department prior to occupancy.
5-year fire sprinkler certification to the Fire
Prior to performing any work, the applicant shall apply to the Building Department for
applicable construction permits. At the time of building permit application for any tenant
improvements, fire sprinkler modification may be necessary as will hazardous materials
review.

PUBLIC WORKS
9. Prior to occupancy of the building by Kaiser Foundation Health Plan, Inc. for medical
operations, the parking space located at the bottom of the pedestrian ramp in the Hacienda
Avenue/Winchester Blvd. Comer of the site, shall be eliminated. The space shall be
striped and signed as a pedestrian walkway so that any vehicle using this space may be
towed.
