RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE EXECUTION OF AN OPERATIONAL AGREEMENT
BETWEEN THE CITY OF CAMPBELL AND COUNTY OF SANTA CLARA FOR
THE COLLECTION OF DNA SAMPLES:

WHEREAS, Proposition 69, the DNA Fingerprint, Unsolved Crime, and
Innocence Protection Act, was approved California voters in 2004.
AND WHEREAS, Proposition 69 requires the collection of DNA samples from
specified adults, including persons required to register as convicted sex offenders
under Penal Code Section 290 or arson offenders under Penal Code Section
457.1.
AND WHEREAS, the County of Santa Clara has offered to extend an
agreement under which the County Probation Department collects DNA samples
from individuals referred by the Campbell Police Department.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell authorizes the City Manager to execute an Operational Agreement with
the County of Santa Clara for in fulfillment of the obligations of Proposition 69 as
related to the collection of DNA samples.
