RESOLUTION NO. 11019
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
VACATING EXCESS RIGHT-OF-WAY ON WESTMONT AVENUE, AUTHORIZING
THE PUBLIC WORKS DIRECTOR TO EXECUTE NECESSARY DOCUMENTS AND
AUTHORIZING CITY CLERK TO RECORD RESOLUTION FOR PROPERTY
LOCATED ADJACENT TO 1265 WESTMONT AVENUE
(APN 403-10-079)
WHEREAS, on August 7, 1990, the Santa Clara Valley Water District (SCVWD)
executed a Grant Deed conveying a certain 45 foot wide strip of land on the north side
of Westmont Avenue westerly of San Tomas Aquino Road to the City of Campbell for
public street purposes, reserving therefrom unto the Grantor, and easement to
construct, reconstruct, inspect, maintain and repair water pipelines and appurtenant
structures upon, over and across the above described land; and
WHEREAS, the City accepted the right-of-way; and
WHEREAS, the proposed vacation is consistent with the San Tomas Area
Neighborhood Plan, as amended by Resolution No. 9633, the General Plan and the
Westmont Avenue Street Improvement Project No. 03-04; and
WHEREAS, there have been five similar vacations of excess right-of-way
subsequent to acquisition of the property from the SCVWD; and
WHEREAS, the SCVWD has agreed to the vacation of the excess right-of-way by
the City, directly to the adjacent property owners, based on the following conditions:
1. The vacated right-of-way will be encumbered by an easement in favor of the
SCVWD.
2. The City's conveyance document must indicate that the SCVWD will not
compensate the owner for damage or improvement costs if the District needs to
enter the property to repair the pipeline.
3. No permanent improvements can be installed in the easement without a permit
from the SCVWD.
4. If the City sells the property, the proceeds should be given to the SCVWD.
5. If the City collects a fee for processing the application for Vacation of Excess
Right-of-Way, one half of the proceeds should be given to the SCVWD.
6. The width of the street vacation should not exceed 15 feet.
7. The future street improvements should be constructed, as generally shown on
Exhibit B.
WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of
Part 3 of Division 9 of the California Street and Highway Code; and
WHEREAS, the property to be vacated is described on the attached Exhibit A,
reserving therefrom a public service easement for the benefit of the City of Campbell, a
public utility easement for the benefit of the utility companies and a pipeline easement
for the benefit of the SCVWD, prohibiting the installation of trees or placement of any
structures including fences within the easement without a permit from the SCVWD;
allowing the SCVWD the right to access, maintain, repair and/or replace the existing
pipeline without compensation to the property owner for damages or improvement costs
over, under and upon said property; and
WHEREAS, the property to be vacated constitutes excess street right-of-way not
required for street or highway purposes; and
WHEREAS, from and after this date that this resolution is recorded, the street
portion of portion thereof vacated, no longer constitutes a public street.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby vacate the excess right-of-way on Westmont Avenue adjacent to
1265 Westmont Avenue (APN 403-10-079), authorizes the Public Works Director to
execute the necessary documents for vacation of this excess right-of-way and
authorizes the City Clerk to record this Resolution.

of California, and being described as follow;
Being a 15 foot wide Northerly strip ofa portion ofWestmont Avenue, 75 feet wide,
lying Easterly of Crocket Avenue and Westerly of San Tomas Aquino Road, and being
more particularly described as follow;
BEGINNING at the Southwesterly comer of Parcel A as shown on that certain Parcel
Map recorded in Book 438 of maps at page 16, Santa Clara County Records, distant
thereon South 83016'48'; West 190.78 feet from the Westerly line of San Tomas Aquino
Road, said point being on the Northerly line ofWestmont Avenue (75.00 feet wide);
thence along the Southerly prolongation of the Westerly line of said Parcel A, South
06051 '00" West 15.43 feet to a line parallel with and 15.00 feet Southerly of the
Northerly line ofWestmont Avenue, being measured at right angles; thence along said
parallel line, North 83016' 48" East 86.23 feet; thence parallel with said Westerly line of
San Tomas Aquino Road North 06051 '00" East 15.43 feet to said Northerly line of
Westmont Avenue; along said Northerly line South 83016'48" West 86.23 feet to the
point of beginning of this description, containing 1293.38 sq.:ft. (0.0297 acres) ofland,

Basis of Bearing is taken South 83016'48" West which is the Northerly line ofWestmont
Avenue as shown on that certain Parcel Map recorded in book 438 of maps at page 16,

Reserving therefrom a Pipeline Easement for the benefit of the Santa Clara Valley Water District
prohibiting the installation of trees or placement of any structures including fences within said easement
without a permit from the Santa Clara Valley Water District and allowing the Santa Clara Valley Water
District the right to access, maintain, repair, and/or replace the existing pipeline without compensation to
the property owner for damages or improvement costs, over, under, and upon said property.
Reserving therefrom pursuant to the provisions of Section 8340 of the Streets and Highways Code and for
the benefit of Pacific Gas and Electric Company and Pacific Bell Telephone Company, dba AT&T
California, the permanent easement and the right at any time and from time to time to construct,
reconstruct, maintain, operate, replace, remove, repair, renew and enlarge lines of pipe, conduits, cables,
wires, poles, electrical conductors and other equipment, fixtures and appurtenances for the operation of
electric, gas, telephone lines and other communication facilities, including access, and also the rights to
trim and cut down trees and brush that may be a hazard to the facilities and keep the property free from
inflammable materials and wood growth, and otherwise protect the same from all hazards; said area shall
be kept open and free of buildings, structures and wells or any kind.
Reserving therefrom a Public Service Easement for the benefit of the City of Campbell.
