PC Res 2431RESOLUTION NO. 2431 PLANNING COtM4ISSI0N BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL DENYING A REQUEST TO ____ INCREASE THE INTENSITY OF A RESTAURANT FROM 23 SEATS TO 45 SEATS ON PROPERTY KNOWN AS 422 E. CAMPBELL AVE., IN AN INTERIM (PLANNED DEVELOPMENT/COMMERCIAL) ZONING DISTRICT. (APPLICATION OF MR. TIM BRINK AND MS. VICKI LOU HILLIG, UP 86-14). After notification and public hearing as specified by law on the application of Mr. Tim Brink and Ms. Vicki Lou Hillig for a Use Permit to increase the intensity of a restaurant use from 23 seats to 45 seats, in an existing building on property known as 422 E. Campbell Ave. in an Interim (Planned Development/Commercial) Zoning District, as per the application filed in the Planning Department on October 2, 1986; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: 1. That the establishment, maintenance, and operation of the proposed use would be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. 2. The use requires an additional 7.3 parking spaces which have not been provided. 3. City policy for buildings Downtown with substandard parking is to allow a change of use to a use of the same or a lesser intensity based on the number of parking spaces required. The proposed use is an increase in intensity requiring an additional 7.3 parking spaces. 4. The City is in the process of developing a Downtown revitalization plan which may recommend additional parking downtown; however, this issue has not yet been resolved. Based on the above findings, the Planning Commission does deny the requested Use Permit. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
