PC Res 2430RESOLUTION NO. 2430 PLANNING COMMISSION BEING AN ORDINANCE OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A VARIANCE TO THE REQUIRED FRONTYARD AND SIDEYARD SETBACKS TO ALLOW CONSTRUCTION OF A TWO-CAR GARAGE ON PROPERTY KNOWN AS 229 EL CANIINITO DR. IN AN R-1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT (APPLICATION OF MR. GRIFFITH CROOKS, V 86-04). After notification and public hearing as specified by law on the application of Mr. Griffith Crooks for a variance to the required frontyard and sideyard setbacks to allow the construction of a two-car garage on property known as 229 E1 Caminito Dr. in an R-1 (Single Family Residential) Zoning District, as per the application filed in the Planning Department on October 16, 1986; and, after presentation by the Planning Director, the hearing was closed. After due consideration of all evidence p,Xesented, the Commission did find as follows: 1. The applicant has not demonstrated that an unnecessary hardship will result if the variance is not granted. 2. Any hardship relating to the property was self-imposed as a result of the conversion of the original garage to living space and the construction of the swimming pool and spa in the rear yard. 3. Approval of the variance would be detrimental to the neighborhood in that cars parking behind the new garage would block the sidewalk. The 1 foot sideyard setback would be detrimental to the neighboring property due to the garage's proximity. 4. That the establishment, maintenance, and operation of the proposed use will be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. 5. The variance would permit a structure with setbacks inconsistent with those in the neighborhood. Based on the above findings, the Planning Commission does hereby recommend approval of the requested variance, subject to the following conditions: Public Works Department 1. Submit application to Parks and Recreation Commission for tree removal permit. Resolution No. 2430 -2- V 86-04 2. Obtain an excavation permit, pay fees and post surety to install driveway.
