PC Res 2425RESOLUTION NO. 2425 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE, AND CONDITIONS OF APPROVAL TO ALLOW CONSTRUCTION OF 4 TOWNHOMES ON PROPERTY KNOWN AS 235 N. THIRD ST. IN A PD (PLANNED DEVELOPMENT/LOW-MEDIUM DENSITY RESIDENTIAL) ZONING DISTRICT (APPLICATION OF MR. KURT ANDERSON, ZC 86-01). After notification and public hearing as specified by law on the application of Mr. Kurt Anderson for approval of a Planned Development Permit, plans, elevations, and development schedule to allow the construction of 4 townhomes on property known as 235 N. Third St., as per the application filed in the Planning Department on March 13, 1986 ;and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. ,. After due consideration of all evidence presented, the Planning Commission did find as follows: 1. That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. 2. The provided parking significantly exceeds the 2.5 spaces required by the Zoning Ordinance, with the provision of 16 parking spaces, or 4 spaces per unit. 3. Although the project exceeds the number of units permitted under the current R-M-S Zoning District, Staff is of the opinion that the applicant has met, or exceeded, all the other development standards of the R-M-S Zoning District. Based on the above findings, the Planning Commission recommends approval of the plans, elevations, development schedule and conditions of approval as presented, and further recommends that the City Council approve a Planned Development Permit and enact the attached Ordinance adopting said plans, elevations, development schedule, and conditions of approval for that portion of the above-referenced Planned Development Zoning District.
