PC Res 2424RESOLUTION NO. 2424 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION _ OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A ZONE CHANGE FROM R-M-S (MULTIPLE FAMILY RESIDENTIAL) TO PD (PLANNED DEVELOPMENT) FOR PROPERTY KNOWN AS 235 N. THIRD ST. AS SHOWN ON THE ATTACHED EXHIBIT (APPLICATION OF MR. KURT ANDERSON; ZC 86-01). After notification and public hearing as specified by law on the proposed amendments to the Zoning Map of the. City of Campbell, and after presentation by the Planning Director, proponents and opponents, the Planning Commission did .determine that the change as .shown in the attached Exhibit A should be made to the Zoning Map based on the following findings: 1. That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or'the general welfare of the City. 2. The provided parking significantly exceeds the 2.5 spaces required by the Zoning Ordinance, with the provision of 16 parking spaces, or 4 spaces per unit. 3. Although the project exceeds the number of units permitted under the current R-M-S Zoning District, Staff is of the opinion that the applicant has met, or exceeded, all the other development standards of the R-M-S Zoning District. 4. The project density of 9.7 units per gross acre is consistent with the General Plan designation of Low-Medium Density Residential (6-13 units per gross acre) shown for this area. The Planning Commission of the City of Campbell recommends that the City Council enact the Ordinance attached hereto making effective the recommended changes to the Zoning Map. Kasolas Chairman ATTEST: Arthur A. Ree Secretary ORDINANCE NO. BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL AMENDING THE ZONING MAP FOR PROPERTY KNOWN AS 235 N. THIRD ST., FROM R-M-S (MULTIPLE FAMILY RESIDENTIAL) TO PD (PLANNED DEVELOPMENT) AS SHOWN ON THE ATTACHED EXHIBIT (APPLICATION OF MR. KURT ANDERSON, ZC 86-01). The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the Zoning Map of the City of Campbell is hereby changed and amended by adopting the attached Exhibit A entitled Mpa of Said Proaprty, as per the application of Mr. Kurt Anderson for approval of a Zone Change for property known as 235 N. Third St. from R-M-S (Multiple Family Residential) to PD (Planned Development). SECTION TWO: This Ordinance shall become effective thirty days following its passage and adoption and shall be published once within fifteen days upon passage and adoption in the San Jose Mercury News, a newspaper of general circulation in the City of Campbell, County of Santa Clara.
