PC Res 2423RESOLUTION NO. 2423 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT _ ALLOWING THE ESTABLISHMENT AND OPERATION OF AN INDOOR RECREATIONAL USE CALLED "COPS & ROBBERS" ON PROPERTY KNOWN AS 645 #A MCGLINCEY LANE IN AN M-1-S (LIGHT INDUSTRIAL) ZONING DISTRICT. (APPLICATION OF MR. JAMES BRAWNER, UP 86-15). After notification and public hearing as specified by law on the application of Mr. James Brawner for a Use Permit to allow the establishment and operation of an indoor recreational use called "Cops & Robbers" on property known as 645 #A McGlincey Lane in an M-1-s (Light Industrial) Zoning District, as per the application filed in the Planning Department on October 30, 1986; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows: 1. That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and __ improvements in the neighborhood or the general welfare of the City. 2. The hours of operation have been restricted in order that adequate - parking will be provided for the use. 3. No alcohol will be allowed to be consumed on the property. 4. The use will be conducted wholly within an enclosed building to .prevent disturbances to adjacent uses. 5. The use will be reviewed in 6 months to evaluate the operation. Based on the above findings, the Planning Commission does hereby grant the requested Use Permit, subject to the following conditions: 1. Hours of operation shall be restricted to: opening not before 8:00 p.m. Friday evening and closing by 8:00 p.m. Sunday evening. Use shall not operate during the business week. 2. There shall be no sale of food or beverages on the site. No customer may bring any alcoholic beverage to the business to be consumed. 3. The use is limited to a maximum of 8 players at any one time. 4. Use to be reviewed by Planning Commission within 6 months to further _ assess the use. The Commission may at that time modify or add conditions. Resolution No. 2423 -2- UP 86-15 5. Prior to occupancy, applicant to obtain permits from the Building Department for interior work and obtain a final inspection from the Building Department. 6. Comply with all requirements of the Fire Department, including flameproofing of sawdust prior to occupancy. The applicant is notified as part of this application that he/she is required to comply with all applicable Codes and/or Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
