PLANNING COMMISSION
BEING AN ORDINANCE OF THE PLANNING COMMISSION
____ OF THE CITY OF CAMPBELL APPROVING A VARIANCE
ALLOWING A VARIANCE TO THE FRONTYARD SETBACK
FROM 15 FEET TO 13.5 FEET ON PROPERTY
KNOWN AS 231 KEN CIRCLE IN AN R-1 (SINGLE
FAMILY RESIDENTIAL) ZONING DISTRICT
(APPLICATION OF MR. JAMES WALKER, V 86-03).
After notification and public hearing as specified by law on the
application of Mr. James Walker for a variance to the frontyard setback
requirement on property known as 231 Ken Circle in an R-1 (Single Family
Residential) Zoning District, as per the application filed in the Planning
Department on October 2, 1986; and, after presentation by the Planning
Director., .the hearing was closed.
After due consideration of all evidence presented, the Commission did find
as follows:
1. That the establishment, maintenance, and operation of the proposed use
will not be detrimental to the health, safety, peace, morals, comfort
or general welfare of the persons residing or working in the
neighborhood of such use, or detrimental or injurious to property and
improvements in the neighborhood or the general. welfare of the City.
2. The property is unique in that it is irregular in shape.
3. Without the. variance, a hardship is imposed on the property owner and
his ability to add to his house is restricted unreasonably.
4. The addition will match the existing structure and will blend into the
neighborhood.
Based on the above findings, the Planning Commission does hereby recommend
approval of the requested variance.
