PC Res 2403RESOLUTION NO. 2403 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION _ OF THE CITY OF CAMPBELL APPROVING A VARIANCE TO ALLOW THE CONSTRUCTION OF A TWO-STORY ADDITION ON PROPERTY KNOWN AS 149 N. SECOND ST. IN AN R-1-6 (SINGLE FMAILY RESIDENTIAL) ZONING DISTRICT (APPLICATION OF MR. JAMES JACQUES, V 86-02). After notification and public hearing as specified by law on the application of Mr. James Jacques for approval of a variance to allow the construction of a 2-story addition to an existing single family home which has a substandard frontyard setback of 6' on property known as 149 N. Second St. in an R-1-6 (Single Family/Low Density Residential) Zoning District, as per the application filed in the Planning Department on June 23, 1986; and after. presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: 1. This property is unique in that it is currently developed with an older single family residence which is situated closer to the street property line than current standards would permit. 2. Relocation of the existing residence would impose a special hardship on the applicant's lot beyond that suffered by his neighbors and would require the removal of a number of existing mature trees on this lot. 3. The granting of the applicant's variance request will not be detrimental to the public welfare or injurious to neighboring properties. 4. Approval of this variance does not establish an undesirable precedent in that this property represents a unique situation with a pre-existing condition. The Planning Commission does hereby grant the requested variance.
