PC Res 2402RESOLUTION N0. 2402 PLANNING COMMISSION BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A USE PERMIT AND PLANS TO ALLOW CONSTRUCTION OF AN ADDITIONAL LIVING UNIT ON PROPERTY KNOWN AS 946 EMORY AVE. IN AN R-1-16 (SINGLE FAMILY RESIDENTIAL, 16,000 SQ.FT. MINIMUM LOT SIZE) ZONING DISTRICT. (APPLICATION OF MS. PATRICIA HENDSCH, UP 86-12). After notification and public hearing as specified by law on the application of Ms. Patricia Hendsch for a Use Permit and approval of plans to allow the construction of an additional living unit on property known as 946 Emory Ave. in an R-1-16 (Single Family Residential - 16,000 sq.ft. minimum lot size) Zoning District, as per the application filed in the Planning Department on July 17, 1986; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Commission did find as follows: 1. That the establishment, maintenance, and operation of the proposed use .will not be detrimental to the health, safety, peace, morals, comfort or general welfare of the persons residing or working in the neighborhood of such use, or detrimental or injurious to property and improvements in the neighborhood or the - -. general welfare of the City. 2. The additional living unit meets all development standards as specified by City ordinance. 3. The unit is of good architectural design. Based on the above findings, the Planning Commission does hereby grant the requested use permit, subject to the following conditions: 1. Obtain all necessary permits from the Building Department. 2. Use permit to be void one year from date of Planning Commission approval, unless a Building Permit is obtained by that date. 3. Prior to occupancy of unit, applicant to provide City Attorney with evidence that a deed restriction has been recorded requiring that not more than one dwelling unit on the property be rented or leased. PUBLIC WORKS DEPARTMENT 4. Execute an agreement to install street improvements in the future . BUILDING, FIRE DEPARTMENTS No comments.
