PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL RECOiM1ENDING DENIAL
OF A REQUEST FOR A USE PERMIT TO ALLOW OFF-SALE
BEER AND WINE ON PROPERTY KNOWN AS 880 E. CAMPBELL
AVE. IN A PD (PLANNED DEVELOPMENT/COMMERCIAL) '
ZONItdG DISTRICT. (APPLICATION OF MR. OM KAMBOJ,
UP 86-08)
After notification and public hearing as specified by law on the
application of Mr. Om Kambo~ for a Use Permit to allow off-sale berr and
wine in a mini-market on property known as 880 E. Campbell Ave., in a PD
(Planned Development/Commercial) Zoning District, as per the application
file in the Planning Department on June 3, 1986, and after presentation by
the Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Commission did find
as follows:
1. That the existing site circulation is not desirable for a short-term
parking demand such as a liquor store; and
2. That the orientation of this type of business towards the residential
neighborhood to the south is not a desirable use.
3. That the establishment, maintenance, and operation of the proposed use
will be detrimental to the health, safety, peace, morals, comfort or
general welfare of the persons residing or working in the neighborhood -'
of such use, or detrimental or injurious to property and improvements
in the neighborhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby deny the
requested use permit.
