PLANNING COMMISSION
BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
' CITY OF CAMPBELL RECOMMENDING APPROVAL OF PLANS,
_ ELEVATIONS, DEVELOPMENT SCIIEDULE, AND CONDITIONS
OF APPROVAL TO ALLOW CONSTRUCTION OF 18 TOWNHOMES
ON PROPERTY KNOWN AS 1164-1180 SMITH AVE. IN A PD
(PLANNED DEVELOPMENT/LOW-MEDIUM DENSITY RESIDENTIAL)
ZOidING DISTRICT (APPLICATION OF MR. ALAN PINN, ZC 86-03).
After notification and public hearing as specified by law on the application of
Mr. Alan Pinn for approval of plans, elevations, and development schedule for
the construction of 17 townhomes located on property known as 1164, 1176, ~
1180 Smith Ave., as per the application filed in the Planning Department on
2-iarch 26, 1986; and, after presentation by the Planning Director, proponents,
and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows
1. That the proposed construction of 18 townhomes would be compatible
with the existing uses in the immediate area and would be compatible
with the Land use Element of the General Plan which indicates
"Low-Medium Density Residential".
2. This development is similar to recent approvals for zone changes to PD
for townhomes developments.
_, 3. That the establishment, maintenance, and operation of the proposed use
will not be detrimental to the health, safety, peace, morals, comfort
or general welfare of the persons residing or working in the
neighborhood of such use, or detrimental or injurious to property and
improvements in the neighborhood or the general welfare of the City.
The Planning Commission of the City of Campbell recommends that the City
Council enact the Ordinance attached hereto approving plans, elevations,
development schedule, and conditions of approval.

CAt4PBELL APPROVING PLANS, ELEVATIONS, DEVELOPMENT
SCHEDULE AND CONDITIONS OF APPROVAL FOR 18 TOWNHOMES
TO BE LOCATED ON PROPERTY KNOWN AS 1164, 1176 & 1180
SMITH AVE. IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT.

The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell is hereby
changed and amended by adopting the attached Exhibit A entitled Plans and
Elevations; Exhibit B entitled Development Schedule; Exhibit C entitled Map of
Said Property; and Exhibit D entitled Conditions of Approval, as per the
application of Mr. Alan Pinn far approval of plans, elevations and development
schedule to construct 18 townhomes on property known as 1164, 1176, & 1180
Smith Ave. in a PD (Punned Development/Low-Medium Density Residential)
Zoning; District. Copies of said exhibits are on file in the Planning
Department.
SECTIOt1 TWO: This Ordinance shall become effective 30 days following
its passage and adoption and shall be published once within 15 days upon
passage and adoption in the San Jose Mercury News, a newspaper of general
circulation in the City of Campbell, County of Santa Clara.

The applicant is notified as part of this application that he/she is required
to meet the following conditions in accordance with the Ordinances of the City
of Campbell and the Laws of the State of California.
1. Property to be fenced and landscaped as indicated and/or added in red on
the plans. Landscaping and fencing shall be maintained in accordance with the
approved plans.
3. Landscaping plan indicating type and size of plant material, and location
of irrigation system to be submitted to the Planning Department and approved by
the Site and Architectural Review Committee and/or Planning Commission prior to
issuance of a building permit.
3. Fencing plan indicating location and. design details of fencing to be
submitted to the Planning Department and approved by the Planning Director
prior to issuance of a building permit.
4. Applicant to either (1) post a faithful performance bond in the amount of
$10,000 to insure landscaping, fencing, and striping of parking areas within 3
months of completion of construction; or (2) file written agreement to complete
landscaping, fencing, and striping of parking areas. Bond or agreement to be
filed with the Planning Department prior to application for a building permit.
S. Applicant to submit a plan to the Planning Department, prior to
installation of PG~E utility (transformer) boxes, indicating the location of
(, the boxes and screening (if boxes are above ground) for approval of the
~_ Planning Director.
6. Building occupancy will not be allowed until public improvements are
installed.
7. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Municipal Code. All parking spaces to be provided with
appropriate concrete curbs or bumper guards.
8. Underground utilities to be provided as required by Section 20.16.070 of
the Campbell Municipal Code.
9. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
10. -Sign application to be submitted in accordance with provisions of the Sign
Ordinance for all signs. No sign to be installed until application. is approved
and permit issued by Planning and Building Departments (Section 21.68.030 of
the Campbell t~iunicipal Code).

11. Ordinance No. 782 of the Campbell Punicipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage and
rubbish produced within the limits of the City of Campbell shall be made with
Green Valley Disposal Company. This requirement applies to all single-family
dwellings, multiple apartment units, to all commercial, business, industrial,
manufacturing, and construction establishments.
12. Applicant shall comply with all appropriate State and City requirements
for the handicapped.
13. Noise levels for the interior of residential units shall comply with
minimum State (Title 25) and local standards as indicated in the Noise Element
of the Campbell General Plan.
14. Applicant is hereby notified that he will be required to pay Park
Dedication In-Lieu Fee which will be assessed at the time the subdivision map
is submitted.
15. The applicant is hereby notified that the property is to be maintained
free of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or be demolished or removed from the --
property. Sect. 11.201 & 11.414, 1979 Ed. Uniform Fire Code.
BUILDING DEPARTMENT
16. No comments at this time, except one-hour walls required when less than 3'0
to property lines - no openings less than 3'0" to property line. Overhangs not
permitted over property line - Table SA, 1982 U.B.C.
PUBLIC WORKS DEPARTMENT
17. File and process a tract map.
18. Install street improvements as required by Director of Public Works.
19. Submit three copies of on site grading and drainage plan for review by the
Director of Public Works.
20. Pay storm drain area fee.
21. Obtain an excavation permit, pay fees and post surety for all work in the
public right of way.
FIRE DEPARTMENT
22. Provide two on-site municipal fire hydrants; one at the corner of Smith and
the driveway and one at the end of the cul-de-sac.
23. Fire hydrants shall be capable of supplying a fireflow of 1500 gallons per
minute.

The following conditions of approval are recommended concerning the subject tentative

Installation of a sanitary sewerage system to serve all lots within the sub-
division in conformance with the proposed plans of the County of Santa Clara
' Sanitation District No. 4. Sanitary sewerage service to be provided by said
District No. 4.
Installation of a water distribution system to serve all lots within the sub-
division in conformance with the plans of the San Jose Water Works.
Water service to be provided by said water company. Fire hydrants and appurte-
- mantes shall be provided and installed at the locations specified by the
Fire Chief, Fire Department, City of Campbell. Fire hydrant maintenance
