PC Res 2378RESOLUTION N0. 2378 PLANNING COr1MISSION CITY OF CAMPBELL, CALIFORNIA After notification and public hearing as specified by law on the application of Mr. and Mrs. Jeffrey Krupp for a use permit and approval of plans to allow the conversion of a garage to a hobby shop and storage room on property known as 174 Cherry Lane in an R-1 (Single Family Residential) Zoning District, as per application filed in the Planning Department on April 11, 1986, and after presentation by the Planning Director, proponents, and opponents, the hearing was closed. (UP 86-04). After due consideration of all evidence presented, the Commission did find as follows: 1. That the establishment, maintenance, .and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to the property and improvements in the neighborhood or the general welfare of the City. 2. The garage to be converted sits 70 feet from the front property line and is partially blocked from view by the house. The 70 foot driveway would allow up to 3 cars to be parked on the property. 3. The converted garage is architecturally compatible with the house on the property and other structures in the neighborhood. 4. The converted garage will be used as a hobby shop and storage building. It will not be used for living or .sleeping purposes. Conditions are imposed to assure that it will not be used as a living-unit. S. The garage conversion will not be detrimental to the health, safety and welfare of people residing in the area or to the City as a whole. Based on the above findings, the Planning Commission does hereby grant the requested use permit, subject to the following conditions: 1. The kitchen shall be removed from the converted garage. This includes removal of any stove, ovens, and refrigerator. All gas lines to be capped. 2. Applicant to obtain a permit from the Building Department .for the garage conversion and parapet wall and to complete all work. 3. Applicant to record an agreement on the property (satisfactory to the City Attorney) stating that the converted garage may not be used for living or sleeping purposes, may not be rented out, and that no kitchen or cooking facilities may be installed in it. It may be used as a hobby room or for the storage of items of the residents of the property. RESOLUTION N0. 23~.. -2- UP 86-04 4. Should the City have reason to believe that the converted garage is not being used as allowed by this use permit, the property owner shall allow inspection of the structure upon 48 hour notice _ after personal service by the City. 5. Conditions 1, 2 and 3 to be satisfied within 90 days of Planning Commission approval of the use permit. 6. Should the holder of the use permit be found in violation of the conditions of said use permit, holder will be responsible for reasonable attorney fees and associated costs in the abatement thereof. This condition agreed to by applicant's representative, Mr. Gregory Price, during public hearing testimony on May 13, • 1986. 7. The entire wall on the east side shall be of one hour construction, including the overhang. The applicant is notified as part of this application that he is required to comply with all applicable codes and/or ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
