PLANNING COMMISSION
After notification and public hearing as specified by law on the
application of Mr. Richard Norman for a variance to the sideyard setback
requirement to allow the construction of a carport approximately one foot
from the side property line on property known as 1030 S. San Tomas Aquino
Rd. in a R-1 (Single Family Residential) Zoning District, as per the
application filed in the Planning Department on November 18, 1985; and,
after presentation by the Planning Director, the hearing was closed (V
85-04).
After due consideration of all evidence presented, the Commission did find
as follows:
1. The hardship was self-imposed since the lot is not unique.
2. The property has one covered parking space and a parking space
behind it, which satisfies the parking regulations of the City.
3. There is adequate space elsewhere on the site to construct a
carport which meets the setback requirements.
4. There is nothing unusually unique about the lot or the house.
The property does have a 12 foot wide easement on it, however
this easement runs along the south property line, whereas the
variance is requested on the north property line. Excluding the
approximately 1,330 sq. ft. of land occupied by the easement, the
lot still contains approximately 7,050 sq. ft. of area whereas
the minimum lot size in this R-1 (Single Family Residential)
zoning district is 6000 sq. ft. Excluding the 12 foot width of
the easement, the lot has 68 feet of width whereas the minimum
average width under the R-1 district is 60 feet.
The house is angled to the side property line, but this is not
unique because other houses in the area are also angled.
Specifically, five other houses on the east side of San Tomas
Aquino Rd. between Lovell and Hacienda are also angled.
5. The carport could be constructed at its present location by
reducing its width from 14 feet to lO feet, which would meet the
5 foot setback requirement and the 10 foot minimum width
requirement for a carport or garage.
