PC Res 2363RESOLUTION N0. 2363 PLANNING COMMISSION CITY OF CAMPBELL, CALIFORNIA After notification and public hearing as specified by law on the application of Mr. Angelo Troquato for a use permit to allow the establishment of a wholesale nursery on property known as 1791 Pollard Rd. in an R-1-9 (Single Family Residential) Zoning District, as per application filed in the Planning Department on October 31, 1985, and after presentation by the Planning Director, proponents, and opponents, the hearing was closed. (UP 85-11). After due consideration of all evidence presented, the Commission did find as follows: 1. That the establishment, maintenance, and operation of the proposed use will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such use, or be detrimental or injurious to the property and improvements in the neighborhood or the general welfare of the City. 2. The proposed use as a wholesale nursery does not adversely affect adjacent residential uses. 3. The traffic characteristics of the proposed nursery are considered acceptable and appropriate for a residential area. 4. Approval of a wholesale nursery at this location is similar to other nursery operations which .have been approved in the Highway 85 corridor as temporary uses. Based on the above findings, the Planning Commission does hereby grant the requested use permit, subject to the following conditions: 1. Applicant to obtain all necessary building and electrical permits. 2. No retail sales are permitted from the premises. 3. Greenhouse lighting to be off between the hours of 9:00 p.m. and 6:00 a.m. The applicant is notified as part of this application that he is required to comply with all applicable codes and/or ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified.
