PLANNING COMMISSION
After notification and public hearing as specified by law on the
application of Rev. Walters Schedler for a variance to the front yard
setback requirement on property known as 952 Kennedy Ave. in an R-1
(Single Family Residential) Zoning District, to allow construction of a
carport, as per the application .filed in the Planning Department on
September 16, 1985; and, after presentation by the Planning Director,
proponents and opponents, the hearing was closed (V 85-03).
After due consideration of all evidence presented, the Commission did find
as follows:
1. The proposal would allow the property to be brought into
conformance with the City of Campbell code which requires a
minimum of one covered parking space for a residential unit.
2. There is inadequate space on the remainder of the property to
construct a carport which would conform to the 25' setback
requirement.
3. It would pose an unreasonable hardship for the applicant to
convert the former garage back to a parking space.
4. This is a unique situation in that the applicant legally
converted the garage under County regulations and now requests
the carport so as to comply with City regulations.
5. The 17'8" driveway would allow adequate space for most cars to be
parked behind the carport.
6. Curbs, gutters, and sidewalks are not installed in front of this
property, thus allowing an additional 10' behind the 17'8"
driveway before the paved street begins.
7. The variance would not be detrimental to residents in the area
and could have a beneficial effect on property values.
8. No written protests have been received as of this writing.
9. This variance and property are unique and it should not promote
an increased number of variance requests for similar situation.
10. The variance will not create a hazard to pedestrians or vehicular
traffic.
11. The Public Works Department has no concerns regarding the
variance.
The Planning Commission does hereby approve the variance as requested,
subject to the following conditions:

1. Applicant to obtain all necessary permits from the Building
Department.
2. Driveway to be paved as required by Campbell Municipal Code.
3. Variance to be void one year from date of approval unless a
building permit has been issued.
4. Plans to come back to Site and Architectural Review Committee for
review of compatibility of structure design with surrounding
neighborhood.
